and the special energy improvement project owned by the City within the Advanced Energy <br />District has been petitioned for by this City as Owner of one hundred percent of the area <br />specially benefited thereby and to be specially assessed for such Plan and public improvements. <br />SECTION 4: As requested in the Petifion, (A) the whole cost of the special energy <br />improvement project, less any payments from the First Suburbs Development Council or the <br />Owner and received by the City shall be specially assessed, in proportion to the benefits that may <br />result from the special energy improvement project, upon the lot and lands of the Owner <br />benefited by the special energy improvement project pursuant to Section 701.05 and Chapter 727 <br />of the Revised Code, and (B) those special assessments (the "Special Assessments"), shall be <br />collected in fifty semi-annual installments. The Owner requests that the last Special <br />Assessments to pay special energy improvement project costs be certified for collection in 2036. <br />The lot and lands of the Owner benefited by the Plan and special energy improvement project is <br />described as follows: <br />Parcel No. 1 <br />Legal Description <br />Parcel # 312-14-119 <br />SECTION 5: The cost of the special energy improvement project shall be $ 365 <br />based upon the plans, specifications, profiles and estimate of cost of the special energy <br />improvement project now on file in the office of the Clerk of Council In accordance with the <br />Petition, the City acknowledges receipt from the Owner of $ 315 in payment of the costs of <br />the special energy improvement project. $ 50 shall be specially assessed in accordance with <br />this resolution and the Petifion. <br />SECTION 6: The Clerk of Council shall maintain on file in his office for public <br />inspection the Special Assessments for the special energy improvement project heretofore <br />delivered to him, which Special Assessments have been prepared based upon the estimate of cost <br />of the improvements now on file in the office of the Clerk of Council and in accordance with the <br />provisions of this resolution and the Petition. <br />-2- <br />4625706v1 <br />
