No interest shall be charged on the unpaid Special Assessments or paid on the special energy improvement project as no securities will be issued in anticipation of the levy or collection of Special Assessments. SECTION 9: This Council finds and determines that all formal actions of this Council. and any of its committees concerning and relating to the adoption of this resolution were taken, and that all deliberations of this Council and of any of its committees that resulted in those formal actions were held, in meetings open to the public, in compliance with the law. SECTION 10: This resolution is declared to be an emergency measure necessary for the immediate preservation of the public peace, .health, safety and property of the City and for the further reason that the immediate effectiveness of this resolution is necessary to permit the acquisition, installing and equipping of a special energy improvement project which is necessary for the Advanced Energy District to pursue a common Plan for special energy improvement projects and which are urgently needed to generate clean renewable energy and improve the environment; wherefore, this resolution shall be in full force and effect from and immediately after its adoption by the required number of votes, otherwise, at the earliest time permitted by law. -3- 4525706v1
