firm or corporation to whom David M. Vet discloses the facts, terms and amount of this <br />Settlement Agreement and Release shall be specifically advised of this confidentially provision <br />and shall be specifically directed by David M. Vet that they shall not disclose the facts, terms and <br />amount of this Settlement Agreement and Release except as permitted in accordance with the <br />terms and provisions of this confidentiality provision. David M. Vet and City of Lakewood <br />further also agree that should David M. Vet violate the terms of this confidentiality provision that <br />City of Lakewood, will be entitled to injunctive relief and liquidated damages in an amount <br />determined by a court of competent jurisdiction rant to exceed the amount received by David M. <br />Vet pursuant to the terms of this Settlement Agreement and Release as this provision of <br />confidentiality is amaterial provision of this Settlement Agreement and Release. <br />It is expressly understood that this Settlement Agreement and Release is subject to an <br />order or approval by the Industrial Commission of•Ohio and/or the Ohio Bureau of Workers' <br />Compensation to the extent such approval is required bylaw, provided that the parties waive <br />hearing of approval of this Settlement Agreement and Release by the Industrial Commission of <br />Ohio and/or Ohio Bureau of Workers' Compensation. David NI. Vet further understands and <br />agrees that any amount paid to him pausuant to this Settlement Agreement and Release is subject <br />to any valid court-ordered child support. <br />-6- <br />
