2. Grantee shall, at its expense, upon installing, constructing, operating, inspecting, <br />maintaining, repairing or replacing [he equipment and facilities that are the subject of this <br />easement, or in the event Grantee or its agents, employees or contractors otherwise damage or <br />disturb the premises, restore all property damaged or disturbed by such activities to the condition <br />existing prior to the disturbance or damage. <br />3. Grantee shall have the right to remove or trim such trees and brush in the Easement <br />Area as is necessary to exercise the rights conveyed herein. <br />4. Grantee agrees it will not seek to hold Grantor, its officers, employees, and agents <br />liable or responsible for anp actions, claims, damages, liabilities, and expenses arising by reason <br />of the use of the Easement Area by, or other actions or omissions of, Grantee or any of its agents, <br />employees, contractors, vendors or other parties acting on behalf of Grantee. Grantee also agrees <br />to obtain, and include Grantor as an additional insured under, a commercial general liability <br />policy having minimum coverage limits of One Million Dollars ($1,000,000) per occurrence, <br />and Two Million Dollars ($2,000,000.00) in the aggregate, and on any other policy of insurance <br />or self-insrnance program of Grantee which covers Grantee for liability to third parties, and also <br />covers property damage to Grantor's property, relating to Grantee's operations and activities, and <br />exercise of the rights hereunder upon the Grantor's premises. <br />5. Grantor represents and warrants to [he Grantee that Grantor is the true and lawful <br />owner of the Premises in fee simple and has full right and power to grant and convey the rights <br />com~eyed herein. <br />6. This Agreement shall bind and inure to the benefit of the parties hereto, their <br />respective successors, representativesand assigns. <br />7.
