SCHEDULEI <br />DEFINITIONS <br />The following terms shall have the following meanings for this Agreement <br />ACM: Asbestos containing material and asbestos contaminated material as described in the <br />Applicable Standards. <br />Applicable Standards: As applicable a) the standards and criteria established in or pursuant to the <br />Clean Air Act (42 U.S.C.A. Section 7401, et. seq.); the USEPA National Emissions Standards for <br />Hazardous Air Pollutants (40 C.F.R., Part 61, Subpart M) and all asbestos regulations, criteria and <br />orders promulgated by: (i) the Occupational Safety & Health Administration (i.e., 29 C.F.R. <br />1926.1101 and 29C.F.R. 1910.134); (ii) USEPA, (iii) United States Department of Transportation, <br />(iv) the Ohio Environmental Protection Agency and (v) the Ohio Department of Health (i.e., Ohio <br />Administrative Code 3745 -20 and 3701 -34); or b) the standards and criteria established in or <br />pursuant to the Toxic Substances Control Act and the regulations at 40 CFR 761, and regulations, <br />criteria and orders promulgated by the USEPA Office of Resource Conservation and Recovery; <br />and c) such other standards and criteria as are established in connection with the USEPA BRLF <br />Program and the Ohio Voluntary Action Program. <br />ASTM: The American Standards of Testing Materials. <br />BFPP: A Bona Fide Prospective Purchaser is a person or entity that acquires ownership of a <br />facility after January 11, 2002 and that establishes it has met the requirements of Subtitle B of <br />Title II of the Small Business Liability Relief and Brownfields Revitalization Act (amending <br />Section 101 (40) of CERCLA) and the Standards and Practices for All Appropriate Inquiry (40 <br />C.F.R. Part 312). <br />BRLF: Brownfield Revolving Loan Fund <br />Budget: The cost breakdown of all removal and disposal costs necessary to complete Subgrantee's <br />Work by line item, including a detailed breakdown of "Eligible Project Costs" from the <br />Remediation Contractor, which Budget is attached hereto as Exhibit B. <br />CERCLA: The Comprehensive Environmental Response, Compensation and Liability Act, 42 <br />U.S.C. § 9607 etseg., as amended. <br />Certificate for Pam: A properly completed Application and Certificate for Payment on AIA <br />G701 and G702 or other form acceptable to Grantor signed by Subgrantee and approved by the <br />Project Engineer, requesting disbursement and certifying, among other things, the amount of the <br />Eligible Costs to be disbursed as a Disbursement from the Budget. <br />23 <br />
