ARTICLE 1 PURPOSE <br />1.01 This Agreement is made between the City of Lakewood, Ohio hereinafter referred to as <br />the "City," and Ohio Fraternal Order of Police, Ohio Labor Council, Inc. (FOP /OLC), hereinafter <br />referred to as the "Union." The "employee" or "employees" where used herein refers to all <br />regular full -time employees in the bargaining unit. The purpose of this Agreement is to provide <br />a fair and responsible method of enabling employees covered by this Agreement to participate <br />through Union representation in the establishment of terms and conditions of their employment <br />and to establish a peaceful procedure for the resolution of all differences between the parties. <br />ARTICLE 2 RECOGNITION <br />2.01 The FOP /OLC is recognized as the sole and exclusive representative for a bargaining unit <br />of all regular full -time Dispatcher employees in the Department of Public Safety for the purpose <br />of establishing terms and conditions of employment. The City will not recognize any other <br />Union, organization, or person as the representative for any of the Dispatcher employees. <br />ARTICLE 3 NON - DISCRIMINATION <br />3.01 Both the City and the Union recognize their respective responsibilities under the Federal <br />and State Civil Rights Laws, fair employment practice acts, and other similar <br />constitutional and statutory requirements. Therefore, both the City and the Union hereby <br />reaffirm their commitments, legal and moral, not to discriminate in any manner relating <br />to employment on the basis of race, color, religion, sex, national origin, age, disability, <br />gender identity /expression, genetic information, military status, veteran status, sexual <br />orientation, union membership or activity, or ancestry. <br />3.02 The City recognizes the right of all Dispatchers to be free to join the Union. The City <br />agrees there shall be no discrimination, interference, restraint, coercion, or reprisal by the City <br />against any employee or any applicant for employment because of Union membership. <br />ARTICLE 4 CHECI{ -OFF <br />4.01 The Employer agrees to deduct from the wages and salaries of bargaining unit members' <br />dues required by the FOP /OLC by payroll deduction. All members of the bargaining unit shall <br />either become dues paying members of the FOP /OLC, or as a condition of continued <br />employment, remit to the FOP /OLC a fair share in the amount set by the FOP /OLC per person <br />per month in accordance with the provisions of Ohio Revised Code 4117.09(c), starting with the <br />sixty -first (61st) day of employment with the employer or the execution date of this Agreement, <br />whichever comes first. <br />4.02 Dues Fair Share Fees shall be paid over by the employer once each month to the <br />FOP /OLC at 222 East Town Street, Columbus, Ohio, 43215, or such other address as set by the <br />FOP /OLC from time to time. <br />
