When the drawings and specifications are at a stage of completion sufficient to provide a <br />GMP or Fixed Price (likely at 60% design stage) and with the prior approval of the City before <br />submission, such partially and/or fully completed documents (the 'Basis Documents ") shall be <br />provided to the DB's construction team, together with the Engineer of Record's ( "EOR ") <br />detailed listing of any incomplete design elements and the EOR's statement of intended scope <br />with respect to such incomplete elements (the 'Design Intent Statement "). Contingent upon the <br />status of the Project and subject to the City's election to proceed further, the parties may enter <br />into an amendment to the Agreement establishing the Contract Sum ( "GMP /Fixed Price <br />Amendment ") as more fully set forth hereafter. <br />5. Construction Services: <br />The DB shall construct the Project pursuant to the Construction Documents as approved <br />by the City and permitting agencies in advance and in accordance with the schedule <br />requirements. The DB shall hold all subcontracts and shall be fully responsible for the means and <br />methods of construction, weekly progress meetings, testing and inspections, project safety, and <br />project completion within the schedule agreed upon in the preconstruction phase. The Work <br />may be performed by self - performance and /or subcontractors in accordance with the Contract <br />Documents. <br />The DB shall provide qualified QA/QC services through the engagement of a City - <br />acceptable inspection/testing firm(s) which shall provide full -time inspection services and <br />materials testing during construction. The designated QA/QC firm shall provide to the FOR and <br />the City daily reports covering the various construction items inspected and the results of the <br />material tests performed per Project specifications and the Construction Documents overall. <br />Each report shall confirm compliance with the Project plans and specifications. Inspections and <br />materials not meeting the Project plans and specifications shall be brought to the immediate <br />attention of the FOR and City Engineer by the QA/QC firm(s). To the extent that inspections are <br />required beyond those above -noted (including those required by governmental entities) such <br />inspection shall be further subject to the review by the QA/QC firm. <br />During the Construction Stage, the FOR shall: <br />Maintain familiarity with the progress and quality of the Work on the Project by <br />observation and checking the progress and quality of the Work; <br />Shall take action as necessary or appropriate to achieve conformity with the <br />Contract Documents, keeping the City fully apprised of the progress and quality <br />as and when the City requests such information, including attending each <br />progress meeting; <br />Visit the Project at such intervals as the City and/or Criteria Engineer require, to <br />review the Work for defective work, to become familiar with the progress and <br />quality of the Work on the Project, and to determine if the Work is proceeding in <br />conformity with the Contract Documents. If the FOR becomes aware, either <br />through such visits or otherwise, of any defective work on the Project, then the <br />FOR shall immediately report such identified and/or presumed Defective Work <br />to the City and the Criteria Engineer; <br />101Pa -e <br />
