The administration had <br />sampled cities like Oberlin, Columbus, Cleveland, and others for how they structure things. <br />One point that had resonated was the sense of equity that it provides for our existing <br />restaurants and food establishments in Lakewood — that there would be some fee associated <br />with mobile food service as well. There was suggestion made of an annual permit rather than <br />a one-time permit. Ultimately, the Committee decided that it needed more time to work on <br />the fee structure. Perhaps we can solidify and discuss those fees at a future meeting. So we <br />did move to defer within committee. <br />Motion by Councilmember Litten, seconded by Council President O'Leary to receive and file <br />the report. <br />All members voted in favor. ORDINANCE 76-18 - AN ORDINANCE to take effect at the earliest period allowed by <br />law, enacting Chapter 1727, Cigarette and Tobacco Vendors; Sales to Persons Under 21, <br />of the Codified Ordinances of the City of Lakewood in order to amend and create <br />regulations involving licensing for and sales of tobacco products. (Placed on 1St reading <br />& referred to HHS 12/17/18) (pg. 10) <br />Motion by President O'Leary, seconded by Vice President Anderson to defer Ordinance 76- <br />18. <br />Director Butler clarified that this Ordinance being on the docket does not have any type of <br />moratorium effect because the proposal is not linked to the Zoning Code and is not proposing <br />a moratorium. He discussed a previous ordinance that proposed a moratorium on certificates <br />of occupancy for vaping retailers and how this ordinance differs. <br />Councilmember Bullock expressed his opinion that there are too many vaping retailers in the <br />City and that he is interested in any legislation related to safeguarding the public against <br />nicotine. <br />
