Motion by President O'Leary, seconded by Vice President Anderson, to receive and file the <br /> communication. <br /> Discussion: Councilmember Bullock asked if Council is being asked to vote on this issue <br /> tonight and President O'Leary explained that Council will not be doing so and will be begin <br /> deliberations on the matter now that the boards and commissions process has played out. <br /> Councilman Rader asked what the Architectural Board of Review's (ABR) role in the project <br /> is and Director Sylvester stated that both the Planning Commission and ABR have approved <br /> the project. <br /> All members voting yea. ORDINANCE 09-19 - AN ORDINANCE to amend Section 1105.02 of the Zoning Code <br /> of the Codified Ordinances of the City of Lakewood by changing and revising the Zoning <br /> Map of the City with respect to certain property as set forth and described as 13900 Lake <br /> Avenue(PPN 312-05-011)from RIM(Single-Family Residential,Medium Density)to PD <br /> (Planned Development). (Placed on 1st reading and referred to Planning Commission/ABR <br /> 3/4/19; 2nd reading 3/18/19) (pg. 52) <br /> Public Comment: <br /> George Quill of 13468 Lake Ave. stated his opposition to the development, expressing his <br /> disappointment that there was not more public information on the project. He did not agree <br /> with the set back distance of 14 feet from the street and asked if the property is not sold and <br /> the gas station remains for the time being,what other business would be allowed to occupy the <br /> site.Director Sylvester stated that the site can remain a legal nonconformity use as a gas station <br /> with vehicle repair and convenience shop. The Planning Department would evaluate future <br /> proposals that come in if they were not proposed for residential use. <br /> Carolyn Gregory of 13888 Lake Ave. stated her opposition to the development. She expressed <br /> her displeasure with the setback distance and the layout of the residential structures. She stated <br /> the project should have grant money available to assist with remediation of the gas tanks on <br /> site. She advocated that the city use its funds to purchase the site, divide it into single family <br /> lots, and sell to developers to make the type of housing consistent with the rest of the block. <br /> Ward Collins of 13475 Lake Ave. stated his opposition to the development. He said there <br /> should be 3 houses on the property and not 5, as the development proposes. He expressed <br /> concerns about the setback distance and the project's potential as a fire hazard. <br /> Justin Smith of 13945 Lake Ave. stated his opposition to the development. He expressed his <br /> belief that the project detracts from the neighborhood and urged the city to reconsider the <br /> proj ect. <br />
