Motion by President O'Leary, seconded by Vice President Anderson to refer Ordinance 9-19 <br /> to Committee of the Whole. <br /> Discussion: Councilwoman George stated her concerns about the project's density, scale, and <br /> proposed setbacks. She added she is not comfortable with the proposal in its current form. <br /> Councilman Litten inquired as to the discussion surrounding the costs of site remediation. <br /> Director Sylvester stated that the owners of WXZ, the site developer, will discuss the costs of <br /> site remediation with Council in the future. Councilman O'Malley asked if the City conducted <br /> a soil analysis on the property a couple of years ago. Director Sylvester said that a resolution <br /> that provided support to apply for funding to do soil analysis passed, but the City was turned <br /> down for funding by the county. Survey work was privately funded by a potential seller and <br /> buyer. <br /> Councilman Rader asked if this matter was set to be discussed at Committee of the Whole on <br /> June 24, 2019 and President O'Leary confirmed that and added that voting on the issue will <br /> take place on July 15th prior to Council's August recess. <br /> Councilman Bullock's stated that the primary concern is the change in character of the area <br /> and that density and setbacks play a role in that, but spoke about the potential tax impacts of <br /> the developments. He highlighted the difference between private sectors and public sectors in <br /> how they operate in regard to the concerns raised at the meeting, noting that this proposal has <br /> the potential to set precedent. <br /> President O'Leary stated his understanding of the concerns in regard to the setback and noted <br /> that he attended Planning Commission and ABR meetings on the project. He added that he is <br /> impressed with the aesthetic look of the proposed properties and noted that Council cannot <br /> consider these proposals in a vacuum and that an up or down vote is needed on the proposal in <br /> front of the body. He noted that there will be more time in Committee to discuss this proposal <br /> starting on June 24th. <br /> On the motion: All members voting yea. Motion passed. <br /> 11. ORDINANCE 13-19 -AN ORDINANCE to take effect immediately provided it receives <br /> the affirmative vote of at least two thirds of the members of Council, or otherwise to take <br /> effect at the earliest period allowed by law, amending Chapter 906, Use of Public Ways <br /> for Small Cell Wireless Facilities and Wireless Support Structures, of the Codified <br /> Ordinances of the City of Lakewood in order to regulate small cell wireless facilities <br /> located in the right-of-way. (Placed on 1st reading and referred to Public Works Committee <br /> 5/6/19) (pg. 54) <br /> Motion by President O'Leary, seconded by Vice President Anderson to defer Ordinance 13- <br /> 19. <br /> All members voting yea. Motion passed. Ordinance 13-19 deferred. <br />
