Please substitute <br />for the original. <br />Anderson, Bullock, George, Litten, <br />ORDINANCE NO. 22 -19 BY: O'Leary, O'Malley, Rader <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least two thirds of the members of Council, or otherwise to take effect at the earliest period <br />allowed by law, amending Chapter 1308, Flood Damage Prevention, of the Codified Ordinances <br />of the City of Lakewood in order to update the City's local flood management regulations to con- <br />form to new federal and state law. <br />WHEREAS, Lakewood must update its floodplain management regulations to account for <br />changes to FEMA's Flood Insurance Rate Maps and Flood Insurance Study, and to create new <br />language to address V Zones along coastal Ohio, in order for our citizens to participate in the <br />National Flood Insurance Program; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised Code, <br />municipalities have the power of local self - government; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised Code, <br />municipalities have the power to enact laws that are for the health, safety, welfare, comfort and <br />peace of the citizens of the municipality; <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of Lake- <br />wood, this Council by a vote of at least two thirds of its members determines that this ordinance is <br />an emergency measure and that it shall take effect immediately after its adoption by Council and <br />approval by the Mayor because of the need to incorporate regulations over the new V Zones into <br />our code by mid - August 2019; now, therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Chapter 1308, Flood Damage Prevention, of the Codified Ordinances of the City <br />of Lakewood, currently reading as follows: <br />CHAPTER 1308 <br />Flood Damage Prevention <br />1308.01 Title. <br />1308.02 Findings of fact. <br />1308.03 Statement of purpose. <br />1308.04 Methods of reducing flood loss. <br />1308.05 Lands to which these regulations apply. <br />1308.06 Basis for establishing the areas of special flood hazard. <br />1308.07 Abrogation and greater restrictions. <br />1308.08 Interpretation. <br />1308.09 Warning and disclaimer of liability. <br />1308.10 Definitions. <br />
