(6) Prevent or obstruct any person, by means of force, intimidation, or deception, from performing
<br />any act to aid in the discovery, apprehension, or prosecution of the other person or child.
<br />(b) A person may be prosecuted for, and may be convicted of or adjudicated a delinquent child
<br />for committing, a violation of division (a) of this section regardless of whether the person or child
<br />aided ultimately is apprehended for, is charged with, is convicted of, pleads guilty to, or is
<br />adjudicated a delinquent child for committing the crime or act the person or child aided committed.
<br />The crime or act the person or child aided committed shall be used under division (c) of this section
<br />in determining the penalty for the violation of division (a) of this section, regardless of whether the
<br />person or child aided ultimately is apprehended for, is charged with, is convicted of, pleads guilty
<br />to, or is adjudicated a delinquent child for committing the crime or act the person or child aided
<br />committed.
<br />(c) (1) whoever violates this section is guilty of obstructing justice.
<br />(2) If the crime committed by the person aided is a misdemeanor or if the act committed by the
<br />child aided would be a misdemeanor if committed by an adult, obstructing justice is a misdemeanor
<br />of the same degree as the crime committed by the person aided or a misdemeanor of the same degree
<br />that the act committed by the child aided would be if committed by an adult.
<br />(d) As used in this section:
<br />(1) "Adult" and "child" have the same meanings as in section 2151.011 of the Revised Code.
<br />(2) "Delinquent child" has the same meaning as in section 2152.02 of the Revised Code.
<br />(3) "Act of terrorism" has the same meaning as in section 2909.21 of the Revised Code.
<br />Section 15. Section 774.04 Safety Requirements, of the Lakewood Codified Ordinances,
<br />currently reading as follows:
<br />774.04 SAFETY REQUIREMENTS.
<br />(a) The provider shall permit parents, guardians or other persons in loco parentis to inspect the
<br />home for safety precautions. The provider shall remove or correct any safety hazard from both
<br />indoor and outdoor areas of the premises accessible to children, including, but not limited to, placing
<br />all toxic, poisonous and dangerous substances and materials out of reach, removing sharp or
<br />dangerous objects, surfaces and hazards, repairing loose flooring boards, and removing peeling
<br />and/or accessible lead paint.
<br />(b) The provider shall have operable smoke detectors, cover all electrical outlets, provide
<br />operable fire extinguishers properly mounted in the kitchen and other appropriate areas, provide
<br />operable flashlights or other emergency lighting, provide an emergency evacuation plan with
<br />alternative escape routes and be in compliance with all applicable codes and regulations.
<br />(c) Outdoor play areas shall be protected from traffic and other hazards, including glass,
<br />construction materials, dangerous or sharp objects or equipment, standing water, animals and
<br />insects. All play equipment shall be kept safe.
<br />(d) No firearms or dangerous ordnance shall be kept anywhere in the provider's home or on the
<br />premises at any time when child day care services are provided.
<br />is hereby repealed and new Section 774.04, Safety Requirements, of the Lakewood Codified
<br />Ordinances, is hereby enacted to read as follows:
