The Committee speculated on the reaction of the scooter companies to this legislation. It was <br /> noted that the companies have already agreed to abide by very similar legislation in Cleveland. It <br /> was stated that the scooters can be physically limited to 12 mph. <br /> The Committee discussed the next steps in the process and agreed that it must reconvene to <br /> decide if the City will establish a contract with a vendor for a scooter share program. <br /> Councilmember Bullock moved to recommend to Council that an update to the traffic code to <br /> enable regulation of scooters and e-bikes be accomplished this year. <br /> Mother was seconded by Councilmember O'Malley. All members voted in favor. Motion passed. <br /> ORDINANCE 29-19 - AN ORDINANCE to take effect immediately provided it receives <br /> the affirmative vote of at least two thirds of the members of Council, or otherwise to take <br /> effect at the earliest period allowed by law amending or repealing various sections of the <br /> Lakewood Codified Ordinances that regulate owning, possessing, purchasing or other <br /> acquisition, transporting, storing, carrying, sale or other transfer, manufacture, keeping, <br /> and reporting of loss or theft of firearms within the City of Lakewood. <br /> Chief Assistant Law Director Swallow introduced Ordinance 29-19, explaining that HB 228 was <br /> adopted by the Ohio General Assembly prohibiting municipalities from regulating certain <br /> aspects of firearms and enacts additional civil penalties for violations. Basically the City is not <br /> allowed to have its own separate Code on these matters,though it is permitted to regulate <br /> behavior related to firearms. <br /> Ms. Swallow took the committee through the legislation section-by-section and explained that <br /> sections were being repealed or amended as required by the Ohio Revised Code. <br /> The Committee discussed the repeal of Section 549.26 related to domestic violence situations. <br /> Ms. Swallow assured the Committee that these situations are addressed in different sections of <br /> the Code and that by repealing 549.26, the City is not ignoring victims of domestic abuse. <br /> The Committee discussed the repeal of Section 549.29 related to the confiscation of weapons <br /> The Committee engaged Captain Wilkins to discuss general circumstances in which LPD interacts <br /> with weapons. She expressed confidence that this ordinance will not substantially alter LPD <br /> procedures and that officers are adequately equipped with the right ordinances and tools to perform <br /> their jobs. <br /> The Committee further discussed the need for the ordinance and the problem of having <br /> unenforceable codes on the books that could confuse officers. <br /> A motion was made by Councilmember Bullock, seconded by Councilmember Litten to <br /> recommend adoption of Ordinance 29-19. <br /> 2 <br />
