Term and shall incorporate this Lease Agreement by reference. The parties shall share equally all <br />recording fees. <br />Section 17. Notices. <br />All written communications that may be or are required to be sent by either party to the other will <br />be deemed to have been properly sent, as follows: <br />(a) If intended for the City, when mailed by certified or registered mail with the postage <br />prepaid, or recognized overnight delivery service which can document delivery, addressed to: <br />City of Lakewood <br />12650 Detroit Avenue <br />Lakewood, Ohio 44107 <br />Attention: Law Director <br />(b) If intended for Lessee, when mailed by certified or registered mail with the postage <br />prepaid, or recognized overnight delivery service which can document delivery, addressed to: <br />Trinity Project LL <br />13316 Madison Avenue <br />Lakewood, Ohio 44107 <br />Attention: Frank Scalish <br />Each party may designate, by written notice, another person or address to whom any <br />communication may be sent. Communications that are mailed to the City or Lessee shall be deemed <br />sufficiently sent for all purposes at the time that communication is mailed by United States certified or <br />registered mail or recognized overnight delivery service. For the purposes of this Lease Agreement, <br />written notices and communications shall be deemed delivered upon the earlier of (1) actual receipt by a <br />party; or (2) three business days following the mailing of the notice or communication in accordance with <br />the terms of this Section 17. <br />Section 18. Successors and Assigns. <br />This Lease Agreement is effective as of the date set forth above and all rights and obligations <br />must be binding upon and inure to the benefit of the parties and their respective permitted successors and <br />assigns. <br />Section 19. Approvals by the City. <br />Unless otherwise provided, any provision of this Lease Agreement which for its administration <br />requires the approval of the City or certification by the City will be interpreted as requiring action by the <br />Mayor of the City or any other official that the Mayor of the City designates inwriting. <br />Section 20. Captions and Titles. <br />All captions and titles in this Lease Agreement are for convenience only and must not be <br />construed as a part of this Lease Agreement. <br />0 <br />
