4. Communication from Planning & Development Director Leininger regarding Ordinance 08-2021 —Substitute version as recommended by the Planning Commission. (pg. 4) Motion by President O'Malley, seconded by Vice President Litten to receive and file the communication. Discussion: In response to the Council President's question, Director Leininger remarked on the legislative history of Ord. 08-2021. Councilmember Shachner asked a clarifying question and remarked that he is comfortable moving forward with the version recommended by Planning Commission, unless his committee colleagues object. SUBSTITUTE ORDINANCE 08-2021 - AN ORDINANCE to take effect August 1, 2021, amending Section 103.02 Definitions and Chapter 1153 Fences of the Codified Ordinances of the City of Lakewood in order to clarify fence installation requirements within the City of Lakewood. (Is' read & referred to HPD 2116121; 2"d reading 311121; sub. referred to Planning Commission 311121; new sub. recommended by Planning Commission 516121) (pg. 5) Motion by President O'Malley, seconded by Vice President Litten to adopt as substituted. Discussion: In response to a Councilmember's question, Commissioner Parmelee discussed the changes to the Fence Code and the real-world applicability to residents. He stated that the revisions make the Code easier for the Building Department to enforce and for residents to understand. On the motion: All members voted in favor. Motion passed.
