Unlawful Transactions in Weapons, of the Codified Ordinances of the City of <br /> Lakewood. <br /> Councilmember Neff introduced Ordinance 18-2021 and explained that the ordinance is <br /> necessary due to two pieces of legislation adopted by the Ohio General Assembly. HB 228 <br /> repealed municipal home rule related to certain weapons violations. SB 140 made further <br /> changes regarding carrying concealed weapons and weapon transactions. Accordingly, <br /> Lakewood must adopt legislation to mirror the Ohio Revised Code (ORC). <br /> Assistant Director Swallow added that the ORC includes provisions that can penalize <br /> municipalities for enforcing local legislation outside the bounds of the ORC. She explained that <br /> officers are aware of this and have instructions not to cite under the local codes at this time. <br /> Councilmember Bullock expressed frustration with the State's restrictions on municipalities and <br /> with the failure to address increasing gun violence. However, he acknowledged Council's legal <br /> obligation to act and stated that he would vote in favor. <br /> After further discussion with the Law Department, it was stated that if the State further amends <br /> the weapons Code, that Lakewood would have to amend ours again at that time. <br /> A motion was made and seconded to recommend Ordinance 18-2021 for adoption. A roll call <br /> vote was taken as follows: <br /> Yeas: Neff, Bullock, Litten <br /> Nays: none <br /> Motion adopted. Ordinance 18-2021 recommended for adoption. <br /> Public Safety Committee adjourned at approximately 6:30 p.m. <br />
