"kick-off' meeting in a virtual, web -based update format, which will include an opportunity for a <br />questions and answers. No less than every six months thereafter during the construction of the <br />Project (commencing with demolition and continuing until certificates of occupancy are issued) <br />the Developers agree to host community update meetings in a virtual, web -based update format, <br />which will include an opportunity for a questions and answers. The Developers shall respond to <br />any reasonable requests made by the City regarding the status of the Developers' community <br />engagement efforts. <br />XVII. MINORITY BUSINESS ENTERPRISES, FEMALEIWOMAN BUSINESS <br />ENTERPRISES, DISADVANTAGED BUSINESS ENTERPRISES AND SMALL <br />BUSINESS ENTERPRISES REQUIREMENTS <br />The City of Lakewood supports diversity and inclusion and encourages the utilization of <br />Minority Business Enterprises, Female/Woman Business Enterprises, Disadvantaged Business <br />Enterprises and Small Business Enterprises as prime and subcontractors, and the utilization of <br />women and minority workers on construction projects. The Developers are expected to undertake <br />commercially reasonable efforts to adhere to and require 10% participation by these enterprises, <br />provided that such participation is subject to availability of qualifying laborers and contractors in <br />the Cleveland -Elyria Metropolitan Statistical Area who also would satisfy the requirements of the <br />Project Labor Agreement (as defined below). It is understood that depending on market <br />conditions, such participation may not be attainable for all elements of the Project. Upon request, <br />the Developers shall provide the City with documentation that reasonably demonstrates the efforts <br />of the Developers, its affiliates, and all contractors and subcontractors to comply with the terms of <br />this Section. <br />XVIII. BUILDING TRADES <br />Developers recognize the value of including building trades in the Project and will work <br />with the building trades in connection with the Project. A Project Labor Agreement (the "Project <br />Labor Ag-reement") or written waiver of the same shall be entered into in a form reasonably <br />satisfactory to the City between the Developers or the Developers' assignee as described in Section <br />XXIX(D) hereof and The Cleveland Building and Construction Trades Council and its affiliates <br />prior to any work beginning on the Project, and shall be provided to the City. <br />XIX. WAGE REQUIREMENT <br />The Developers and the City acknowledge and agree that construction of the Project is <br />subject to the prevailing wage requirements of Ohio Revised Code Chapter 4115 and all wages <br />paid to laborers and mechanics employed in constructing the Project shall be paid at not less than <br />the prevailing rates of wages of laborers and mechanics for the classes of work called for by the <br />Project, which wages shall be determined in accordance with the requirements of that Chapter <br />4115. The Developers shall require compliance by all contractors, and shall require all contractors <br />to require all subcontractors working on the (reimbursable) aspects of the Project, to comply with <br />all applicable requirements of that Chapter 4115. Upon request, the Developers shall submit, in a <br />format reasonably acceptable to the City, a reconciliation of all wages paid to its employees, <br />17 <br />
