(pg. 35) <br /> Motion by President O'Malley, seconded by Vice President Litten to refer Resolution 2022-09 <br /> to the Housing, Planning, & Development Committee. All in favor. Motion passed. Resolution <br /> 2022-09 was referred to the Housing, Planning, & Development Committee. <br /> 17. Communication from Law Director Corrigan regarding Lakewood erosion control <br /> Shoreline Improvement District. (pg. 37) <br /> Motion by President O'Malley, seconded by Vice President Litten to receive and file the <br /> communication. All in favor. Motion passed. The communication was received and filed. <br /> 18. RESOLUTION 2022-10 - A RESOLUTION to take effect immediately provided it <br /> receives the affirmative vote of at least two thirds of the members of Council, or <br /> otherwise to take effect at the earliest period allowed by law approving a petition for the <br /> creation of a shoreline special improvement district and for the levy of special <br /> assessments for shoreline improvement projects. (pg. 38) <br /> Motion by President O'Malley, seconded by Vice President Litten to refer Resolution 2022-10 <br /> to the Rules & Ordinances Committee. All in favor. Motion passed. Resolution 2022-10 was <br /> referred to the Rules & Ordinances Committee. <br /> 19. Communication from Law Director Corrigan regarding LCO 335.01 Driver's or <br /> Commercial Driver's License Required. (pg. 40) <br /> Motion by President O'Malley, seconded by Vice President Litten to receive and file the <br /> communication. <br /> Discussion: Committee members engaged in an exchange with Director Corrigan on the <br /> necessity of the ordinance. Director Corrigan states that Lakewood's current penalty for driving <br /> without a license is a 1st degree misdemeanor, while the Ohio Revised Code's penalty is an <br /> unclassified misdemeanor. He explained that the City can not enforce a penalty that is more <br /> severe than the state's. <br /> On the motion: All in favor. Motion passed. The communication was received and filed. <br /> 20. ORDINANCE 15-2022 - AN ORDINANCE to take effect immediately provided it <br /> receives the affirmative vote of at least five (5) members of Council, or otherwise to <br /> take effect and be in force after the earliest period allowed by law, amending Section <br /> 10 <br />
