Councilmember Marx clarified with Director Leininger that Ordinance 33-2022 does not include parklets regarding outdoor dining. The parklets can be approved by the Planning Commission in concurrence with the Safety Forces. On the motion: All in favor. Motion passed. Ordinance 33-2022 referred to Housing, Planning, & Developing Committee and the Planning Commission. 18. ORDINANCE 34-2022 - AN ORDINANCE enacting new Subsection 1161.03(AA) of the Lakewood Codified Ordinances to include and distinguish medical and cosmetic tattooing as a conditional use in commercial zones. (pg. 056) Motion by President Litten, seconded by Councilmember Rader to refer Ordinance 34-2022 to Housing, Planning & Development and the Planning Commission. All in favor. Motion passed. 19. Communication from Director Ducu regarding ODNR Urban Tree Canopy Restoration Grant. (pg. 058) Motion by President Litten, seconded by Vice President Kepple to receive and file written communication. All in favor. Motion passed. 20. RESOLUTION 2022-41 - A RESOLUTION to take effect immediately providing it receives the affirmative vote of at least two thirds of the members of the Council, or otherwise to take effect and be in force after the earliest period allowed by law, authorizing the Mayor and/or Director of Public Works to file an Urban Canopy Restoration Grant Application with the Ohio Department of Natural Resources (ODNR) requesting $25,000 in matching state funds to support the planting of trees on public lands during the fall 2023 planting season, and to obligate funds to satisfactorily complete the proposed project by December 31, 2023. (pg. 059) Motion by President Litten, seconded by Vice President Kepple to adopt Resolution 2022-41. Discussion: Councilmember Rader expressed his support for Resolution 2022-41 and mentioned that the Grant Application has been forwarded to Council via email. Vice President Kepple clarified with Director Ducu that the grant would allow tree canopies outside of the equity zones unlike the previous grant. On the motion: All in favor. Motion passed. Resolution 2022-41 was adopted. 21. Communication from Chief Dunphy regarding Fire Prevention Week 2022. (pg. 061) Motion by President Litten, seconded by Vice President Kepple to receive and file the written communication. All in favor. Motion passed. 22. RESOLUTION 2022-42 - A RESOLUTION calling upon the citizens of Lakewood to participate in fire prevention activities at home during the week of October 9, 2022, and to heed the message, "Fire won't wait. Plan your escape." as the 2022 Fire Prevention Week theme suggests. (pg. 062) 7
