16.06 Liability Insurance. <br />A. Subject to the limits of the policy, whenever a member is on duty, insurance coverage shall <br />be provided when said member of the Division of Fire is operating any city owned vehicle <br />in the performance of assigned duties to protect the member fully against any and all claims <br />arising out of the authorized operation of said city vehicle. This insurance must cover all <br />claims for property damage and personal injury, and shall be the sole responsibility of the <br />City to provide and maintain. Additionally, the City will provide full legal defense to any <br />member in any legal action arising out of the authorized operation of said city vehicle. <br />16.07 Surviving Spouse Benefit <br />A. The City shall provide an Accidental Death and Dismemberment (AD&D) Insurance Policy <br />for all bargaining unit members in the amount of $180,000.00. In the event an employee is <br />killed in the line of duty and the above -referenced AD&D policy does not apply, then the <br />surviving spouse or estate of said employee shall be compensated in the amount of <br />$180,000.00. This benefit shall be paid in three (3) equal installments over the course of <br />three (3) years. <br />ARTICLE 17 <br />DISCRIMINATION <br />17.01 The City agrees not to discriminate against any member because of activity in behalf of, or <br />membership in, or lack of membership in the Association. The City and the Association further agree <br />that there shall be no discrimination against any member because of race, sex, creed, religion, national <br />origin, disability, gender identity/expression, genetic information, military status, veteran status, sexual <br />orientation, union membership or activity, or ancestry. <br />ARTICLE 18 <br />DISCIPLINE <br />18.01 In all cases where written and formal charges have been placed against members which could <br />result in reprimand, loss of off -duty time, suspension, fine or punishment of any kind, the member shall <br />receive from the Chief of Fire copies of the exact charges filed. In the case of company discipline, a <br />member may request their immediate supervisor to furnish written and formal charges. To the extent <br />practical, a hearing shall be held no less than seven (7) days and not later than fourteen (14) days after <br />the issuance of the charge. <br />18.02 At the request of the member, the Association may provide appropriate defense for the member <br />during any hearing of said charges. <br />17 <br />
