notifying the City, in writing, of the pending absence is solely that of the <br />employee. Prior to the rehiring of individuals placed on extended active duty <br />for training, a copy of orders stating such release must be presented to the <br />Department of Human Resources. <br />D. Employees on military leave who thereafter return to employment with the <br />City shall be reinstated at the current, applicable rate for his job, provided <br />that the employee, who completes their active duty obligation (without <br />voluntarily re -enlisting or extending that obligation) are entitled to their <br />previous position according to the following schedule: <br />LENGTH OF TOUR <br />1— 30 Days <br />31 — 180 Days <br />181+ Days <br />DAYS TO NOTIFY EMPLOYEER <br />Next Business Day <br />14 Days <br />90 Days <br />ARTICLE 18 SICK TIME PAY & PAID <br />PARENTAL/CHILDBIRTH LEAVE <br />18.01 Effective January 1, 2002, all employees shall earn sick time pay at the rate of 4.6 hours for <br />every eighty (80) hours paid and may accumulate such sick time to nine hundred and sixty (960) <br />hours. Sick time pay may be utilized on account of illness or injury incapacitating the employee from <br />working and requiring the employee's absence or to care for sick or injured, pregnant, or newborn <br />members of the employee's immediate family. Immediate family for the purpose of this Article <br />shall be defined as spouse, son, daughter, stepchild, mother, father or stepparent. If the marriage of <br />people of the same sex is no longer permitted by law the definition of spouse will include same -sex <br />partners and the definition of stepchild will include the children of same -sex partners. <br />18.02 If the employee is absent from work for more than two (2) consecutive days, the employee <br />must complete a Certificate of Illness or Injury form and have their physician complete the <br />Attending Physician's Statement or attach an acceptable statement from the physician to the <br />Certificate that indicates that the employee is able to return to regularly assigned duties. <br />Sick absences will be counted even if interrupted by other days off, i.e. sick Friday, regular <br />scheduled days off Saturday, Sunday, sick Monday, and Tuesday will count as more than two (2) <br />consecutive working days. <br />18.03 Any abuse or patterned use of sick time shall be just and sufficient cause for disciplinary <br />action, and the City's Sick Abuse policy shall apply. <br />18.04 In the event an employee becomes or continues to be incapacitated from work by illness or <br />injury, after exhaustion of his acquired sick time, they may apply for donations of time according to <br />the Sick Time Donation policy. <br />20 <br />
