Grateful for input. <br />Councilmember Shachner asked questions about enforcement of penalties on an LLC. Director <br />Vargo explained that an LLC can apply for the permit and pay penalties. Community service may <br />be performed by the owner operator. <br />In response to a question, Director Vargo addressed a question about repair work being done <br />outside. He explained that businesses will not be penalized for conducting minor work outside, if <br />they have the capacity to perform the majority of their routine work inside. This would be <br />determined at an inspection. <br />In response to questions from Council, Director Vargo clarified that the ordinance is not intended <br />to apply to an auto parts retail store. He also mentioned that an accessory lot for an automobile <br />repair business remains legal under this ordinance. <br />Councilmember Baker suggested that the ordinance only restrict the use of on-street parking <br />overnight, or after a certain hour. He asked about the nature of the training that building <br />department staff will receive. <br />Director Vargo assured Council that building department staff would receive appropriate training <br />between adoption of the ordinance and enactment on January 1, 2024. <br /> <br />Councilmember Baker suggested that the ordinance reference professional industry standards to <br />increase objectivity. <br /> <br />Addressing Mr. Baker’s suggestion to limit enforcement of on-street parking to evening hours <br />only, Councilmember Bullock stated that he wants the legislation to deter gamesmanship by any <br />business owner. He noted that in practice, an occasional short-term use of on-street parking will <br />be hard to enforce. He added that responsible businesses will be able to avoid using on-street <br />parking through effective management practices. <br />Mayor George added that the intent of the legislation is to address parking day and night to keep <br />spaces available to the public. She noted that food trucks are not allowed to use public spaces to <br />support their businesses, and neither are automotive repair businesses. <br />Councilmember Shachner asked for a draft of rules and regulations that will be used to enforce <br />the day-to-day situations that will arise. He advocated that it would be most fair to educate and <br />set expectations among those who will be regulated under this new ordinance. <br />Councilmember Bullock recommended the following change to 781.06 (d): <br />An Automobile Business Operation that was operating its business prior to the denial of a permit <br />or a permit renewal application or the suspension or revocation of a permit may continue to <br />operate during the pendency of an appeal. <br />2 <br /> <br /> <br />
