(referred to COW 10/16/23) (pg. 11) <br />Public Comment: Barbara Rhodes, residing at 1475 Grace Avenue, expressed curiosity regarding <br />the executive session held at the October 30, 2023 Committee of the Whole Meeting. She <br />inquired about the identification of the engineering contractor involved in the ordinance and <br />sought clarification on the specifics of the claim. Barbara also expressed interest in whether there <br />exists a public record documenting the city's claim from this anonymous contractor. <br /> <br />President Litten responded by stating that Council always takes the need to go into executive <br />session very seriously. He highlighted that executive sessions only occur during situations where <br />there is legal need to do so. Law Director Vargo stated that any public records request would <br />identify the identity of the contractor with whom the settlement is with. Furthermore, he stated <br />that he is not aware if there is a public record of this claim or if it was the subject of oral <br />negotiation. <br /> <br />Barbara Rhodes then asked if it is possible that this claim has never been recorded and never will <br />be recorded for the public to review. Law Director Vargo responded by saying that a public <br />records request would be the ideal solution to properly answer this question. <br /> <br />Motion by President Litten, seconded by Vice President Kepple, to adopt Resolution 2023-52. <br />All in favor. Motion passed. Resolution 2023-52 adopted. <br /> <br />10. Report from Committee of the Whole held November 6, 2023. (to be provided) <br /> <br />President Litten delivered the following report: <br /> <br /> The Committee of the Whole met earlier this evening to discuss the Lakewood <br />ADA Self-Evaluation and Transition plan. We had Lakewood’s consultant on the <br />matter, Steve Metzer, present as well as members from the ADA Task Force, <br />Director Leininger and other members of the administration who provided a <br />presentation. The presentation was thorough in terms of addressing high, medium, <br />and low priority items. It is important for us to financially understand how we can <br />make our city as accessible as possible. <br /> <br />Motion by President Litte, seconded by Vice President Kepple, to receive and file the oral report. <br />All in favor. Motion passed. <br /> <br />11. RESOLUTION 2023-51 - A RESOLUTION to take effect immediately provided it <br />receives the affirmative vote of at least five (5) members of Council, or otherwise to take <br /> effect and be in force aftertheearliest period allowed by law, adopting the City of <br />Lakewood ADA Self-Evaluation and Transition Plan (SETP). (Referred to COW <br />10/16/23) (pg. 12) <br /> <br />Discussion: President Litten expressed his desire for ADA Task Force members to be in <br />attendance when Council considers the adoption of Resolution 2023-51. Given the ADA Task <br />Force’s significant contributions, Council should aim to adopt the resolution while members are <br />4 <br /> <br />
