<br />MINUTES OF THE HOUSING, PLANNING & DEVELOPMENT COMMITTEE <br />JANUARY 16, 2024 <br />AUDITORIUM <br />Present: Councilmembers Bullock (Chair), Shachner, Baker <br />lso Present: Councilmember Marx, Councilmember Strebig, Law Director Vargo, Planning <br />A <br />Director Leininger, and Council Staff. <br />Call to Order: 6:08 p.m. <br />Chair Bullock shared that committee assignments have been updated and Councilmember Baker <br />is new to the committee. Councilmember Shachner will remain on the committee and <br />Councilmember Bullock will remain as Chair. <br />Approval of the minutes of the November 13, 2023 Housing, Planning & <br />Development Committee meeting. <br />Motion was made and seconded to approve the minutes of the November 13, 2023 Housing, <br />Planning & Development Committee meeting. All members voted in favor. Motion passed. <br />Minutes approved. <br />*** <br />ORDINANCE 39-2023 - AN ORDINANCE amending Subsection 1161.03(Z) and <br />1161.03(AA) of the Lakewood Codified Ordinances to include body piercing as a <br />conditional use in commercial zones. (1st read and referred to PC and HPD 12/18/23; 2nd <br />reading 1/2/24) <br />Discussion: It was explained that the goal of this ordinance is to clarify zoning regulations for <br />body piercing institutions so that they may operate separate from a body art establishment (tattoo <br />parlor). If adopted, a body piercing institution could apply for a permit to operate as a stand- <br />alone facility, or within an established beauty or medical salon. Body piercing institutions will <br />still need to meet all licensing and health requirements as governed by state law and the local <br />health department. <br />In response to a question from Councilmember Shachner, Director Leininger explained that the <br />language in section (z)(10) of the proposed amendment was intended to clarify that body <br />piercing will be regulated as a conditional use in line with cosmetic and medical tattoo <br />establishment regulations. It was not meant to indicate that body art establishments (tattoo <br />parlors) are no longer allowed to offer body piercing as a service. He said that if a body art <br />establishment meets the state licensing requirements and they have a conditional use permit then <br />they already meet the standards for a body piercing establishment. <br />A discussion followed about how the proposed language is adding a layer of unintended <br />confusion to the regulations, and potential ways they could remove the confusion by modifying <br />the language.
