Any fire, going out of business, relocation, bankruptcy or similar sales (unless <br />pursuant to court order). <br />o. Any central laundry, dry cleaning plant, or laundromat; provided, however, this <br />restriction shall not apply to any dry cleaning facility providing on -site service <br />oriented to pickup and delivery by the ultimate consumer, including, nominal <br />supporting facilities. <br />p. Any operation for the sale, distribution, or display of firearms or ammunition. <br />q. Any funeral home, crematorium or mortuary. <br />r. Any operation whose principal use is a massage parlor; provided this shall not <br />prohibit massages in connection with a beauty salon or health club or athletic <br />facility or regional/national brand name massage service providers not <br />exceeding 5,000 square feet. <br />s. Any recycling facility or stockyard. <br />t. Any carnivals, fairs or auctions. <br />u. Any industrial, factory or manufacturing warehouse operation (excluding any <br />warehousing incidental to the operation of permitted retail uses). <br />v. Any dumping, disposing, incinerating, or reducing of garbage (exclusive of <br />dumpsters for the temporary storage of garbage and any garbage compactors, <br />in each case which are regularly emptied so as to minimize offensive odors) or <br />other garbage or scrap dump or processing operating. <br />W. "For sale" residential property; provided, however, multi -family and/or other <br />residential rental property shall be a permitted use. <br />2. Survival. Subject to applicable law, including, without limitation, the rule against <br />perpetuities (and any similar laws then in effect and applicable to the Development Property), the <br />Prohibited Uses shall be a covenant running with the land, and shall be binding upon and inure to <br />the benefit of the Parties and any successors and assigns of the Parties, including any future owners <br />of the Development Property. <br />[Signature pages immediately follow] <br />D-3 <br />
