ORDINANCE NO. 3381 BY Mr. Myers An ordinance providing for the licensing and regulation of deal- ers in second-hand articles. NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKE- WOOD, STATE OF OHIO. Section 1. Definition. Any person, or persons, co-partnership or corporation dealing in the purchase or sale of second-hand articles of whatever nature or dealing in the purchase or sale of any second- hand manufactured article composed wholly or in part of gold, silver, platinum, or other precious metals for selling or otherwise using the same, or in the purchase or sale of old gold, silver, or platinum for the purpose of selling, or in the purchase or sale of pawn-broker tickets or other evidence of pledged articles, or, not being a pawnbroker, who deals in the redemption or sale of furs, clothing or other pledged articles, is hereby defined to be a dealer in second-hand articles. Section 2. No person, firm or corporation shall engage in the business of keeping a second-hand store or a place for buying and selling second-hand goods in the city of Lakewood~ as defined in the preceding section, until he has first obtained a license to engage in and carry on the said business. Every applicant for a license shall make application in writing to the Director of ~ublic Works, which application shall set forth the name under which the business is to be conducted, and the name of every person interested in the said business and the location where the business is to be carried on. The applica- tion must be made by the person or persons who are to carry on the business and must contain references of at least two other citizens of the City of Lakewood as to the character of the applicant or applicants. Section 3. Licenses for carrying on the business of keeping a second hand store or a place for buying and selling second-hand goods shall be issued annually and shall expire annually on the 31st day of December. The license fee shall be Ten Dollars ($10.OO) for each year. The license shall contain the name under which the business is to be conducted, the name of every person interested in the business and the location where the business is to be carried on. Licenses issued under this ordinance shall not be transferable to any other person and the business may be conducted only at the location for which the license is issued and the license must be so placed as to be made conspicuously visible. Section ~. Every licensee under this ordinance shall execute and file a bond in the sum of Five Hundred Dollars ($500.00~, with the surety to the satisfaction of the Director of Law that such licensee will conform to the requirements of law and ordinance of the City of Lakewood. Section 5. Every person so licensed shall keep a book in which shall be written in ink in the English language at the time of the purchase of any second-hand article or articles, a description thereof, and the[price paid the seller therefor, together with a statement of the age, address and personal description of the person or persons from whom such purchase was made, and also the date and hour of such purchase and which statement shall also be signed in the book by the seller.
