ORDINANCE NO. 3381 BY Mr. Myers <br /> <br /> An ordinance providing for the licensing and regulation of deal- <br />ers in second-hand articles. <br /> <br /> NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKE- <br />WOOD, STATE OF OHIO. <br /> <br /> Section 1. Definition. Any person, or persons, co-partnership <br />or corporation dealing in the purchase or sale of second-hand articles <br />of whatever nature or dealing in the purchase or sale of any second- <br />hand manufactured article composed wholly or in part of gold, silver, <br />platinum, or other precious metals for selling or otherwise using the <br />same, or in the purchase or sale of old gold, silver, or platinum for <br />the purpose of selling, or in the purchase or sale of pawn-broker tickets <br />or other evidence of pledged articles, or, not being a pawnbroker, who <br />deals in the redemption or sale of furs, clothing or other pledged <br />articles, is hereby defined to be a dealer in second-hand articles. <br /> <br /> Section 2. No person, firm or corporation shall engage in the <br />business of keeping a second-hand store or a place for buying and <br />selling second-hand goods in the city of Lakewood~ as defined in the <br />preceding section, until he has first obtained a license to engage in <br />and carry on the said business. Every applicant for a license shall <br />make application in writing to the Director of ~ublic Works, which <br />application shall set forth the name under which the business is to be <br />conducted, and the name of every person interested in the said business <br />and the location where the business is to be carried on. The applica- <br />tion must be made by the person or persons who are to carry on the <br />business and must contain references of at least two other citizens of <br />the City of Lakewood as to the character of the applicant or applicants. <br /> <br /> Section 3. Licenses for carrying on the business of keeping a <br />second hand store or a place for buying and selling second-hand goods <br />shall be issued annually and shall expire annually on the 31st day of <br />December. The license fee shall be Ten Dollars ($10.OO) for each year. <br />The license shall contain the name under which the business is to be <br />conducted, the name of every person interested in the business and the <br />location where the business is to be carried on. Licenses issued under <br />this ordinance shall not be transferable to any other person and the <br />business may be conducted only at the location for which the license <br />is issued and the license must be so placed as to be made conspicuously <br />visible. <br /> <br /> Section ~. Every licensee under this ordinance shall execute <br />and file a bond in the sum of Five Hundred Dollars ($500.00~, with the <br />surety to the satisfaction of the Director of Law that such licensee <br />will conform to the requirements of law and ordinance of the City of <br />Lakewood. <br /> <br /> Section 5. Every person so licensed shall keep a book in which <br />shall be written in ink in the English language at the time of the <br />purchase of any second-hand article or articles, a description thereof, <br />and the[price paid the seller therefor, together with a statement of <br />the age, address and personal description of the person or persons from <br />whom such purchase was made, and also the date and hour of such purchase <br />and which statement shall also be signed in the book by the seller. Such <br />book shall at all times be open to the inspection of any member of the <br />police force of the City of Lakewood. Such book shall be substantially <br /> <br /> <br />
