<br />AN E~RGENCY 0RDINA~ICE authorizing the Mayor-ex officio Director of
<br />Public Works to enter into a contract for the City of Lakewood, ~io,
<br />with John T. C~bell, D, E. Davis and E. E. Bsnkson, partners doing
<br />business as The Chester Engineers of the Cit~ of Pittsburgh, Pennsylvan~
<br />engineers, for furnishing and performing complete and expert engineerin~
<br />services in connection with the planning and construction of the water
<br />works improvement for the City of Lakewood.
<br />
<br />E~EF~EAS, an emergency exists for the immediate preservation of the
<br />public health, safety and property and to provide for the usual daily
<br />operation of a municipal department, arising Out of the necessity of
<br />constructing a water works improVement without delay:
<br />
<br />THEI~EFORE, BE IT ORDAINED BY THE COUNCIL 0F THE CITY 0FLAKEE!00D, STATE
<br />OF 0HI0, two-thirds (2/3) of all members thereof concurring:~
<br />
<br />Section 1. That this Council hereby declares that the subject matter
<br />of this ordinance is the securing of professional services which cannot
<br />with propriety, be made a matter of competitive bidding or competitive
<br />examinations and, therefore, the Mayor - ex-officio Director of Public
<br />Works - is hereby authorized and directed to enter into a contract in
<br />the name of the City with John T. Campbell, D. E. Davis and E. E. Bank-
<br />son, partners doing business as The Chester Engineers of the City of
<br />Pittsburgh,~ Pennsylvania, engineer~,~ which contract shall be as follows
<br /> This agreement made and entered into at Lakewood, Ohio, this
<br />
<br /> day of 1939, bet. ween the City of Lal~ewood, State of Ohio, by
<br />Amos I, Kauffman, its ~,~ayor and Director of Public Works, hereinafter
<br />
<br />designated the City, party of the first part, and John T. Campbell,
<br />
<br />D. E. Davis and E. E. Bankson, partners doing business as The Chester
<br />
<br />Engineers, all of She City of Pittsburgh, Allegheny County, Pennsylvani
<br />hereinafter designated the Engineers, parties of the second part,
<br />
<br />WITNESSETH:
<br />
<br />WHEREAS, the City proposes to construct improvements to its
<br />
<br />water works to the extent that the capacity thereof shall be sufficient
<br />
<br />to furnish twenty million gallons of water per day, and
<br />
<br /> '~.~EREAS, by re~olution duly adopted~on the eighteenth day of
<br />September 1~9, the Co~ncil of the City, authorized the emplo~uuent
<br />
<br />of the Engine&rs to render engineering services pertaining to and in
<br />
<br />connection with the planning and construction of the water works
<br />
<br />improvement for the City
<br />
<br />N0~ THEREFORE, in consideration of the prem~i~ses and of the
<br />
<br />mutual prmmises made and obligations assumed herein by each. to the
<br />
<br />other, the parties hereto agree as follows:
