Clarke <br /> AId ~'~iE_RGENCY OItDINAIdCE authorizing the Mayor to accept a deed from <br /> the Board of Education of the City School District of the City of Lakewcod con- <br /> veying to the City of Lakewood property located on Bunts Road near the southwest <br /> intersection of Bunts Road and Franklin Boulevard in the City of La'revrood. <br /> Va'I REA5, the Board of Education of the City School District of the City <br /> of Lakewood, on April 10, 1941, adopted a resolution with respect to deeding <br /> a parcel of land to the City of Lakewood for the purpose of widening Bunts Road <br /> beginning at a point approximately 62,57 feet southerly from the center line of <br /> Franklin Boulevard then extending southerly a distance of approximately 433 feet, <br /> as detailed on a plat dated April 7, 1941 prepared by and on file in the Division <br /> of Engineering of the City of Lakewood; and <br /> WHEREAS, this ordinance constitutes an emergency in that it is necessary <br /> immediately to proceed with and complete the proposed widening of_ Bunts Road <br /> prior to the construction of the water main now being built in Bunts Road <br /> by the City of Cleveland and in order to provide for the usual daily operation <br /> of a municipal department, now, therefore <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LP.KL~''OOD, STATE OF OHIO: <br /> SECTIOD? 1, That the Mayor be, and he is hereby authorized, to accept a <br /> ed <br /> ecTfrom <br /> the Board of education of the City School District of the City <br /> of Laketi^rood conveying to the City of Lakewood the property, and subject <br /> to the reservations, set forth in Section 2 of the Resolution adopted by <br /> said Board of Education April 10, 1941, reading a.s follows: <br /> "Section 2: That the President and Clerk of the Board of Education <br /> be and they are hereby authorized to execute and delivex to the City <br /> of Lakewood a limited warranty deed conveying the property described <br /> as follo~+rs; <br /> Situated in Section 22, Rockport Township, now in the City of <br /> Lake-rrood, Cuyahoga County, Ohio. <br /> Starting at a monument in the center line of Bunts Road and <br /> Franklin Boulevard, to the east; thence south in the center line <br /> of Bunts Road, 62.57 feet to a point; thence west 30.00 feet to <br /> the true place of beginning, in the west line of B~.xnts Road; <br /> thence south 51° 03" west, 20.57 feet to a point; thence south <br /> 425.00 feet parallel to the center line of Bunts Road and 46.00 <br /> feet distant therefrom to a point of curve; thence southeasterly <br /> in the arc of a curve whose radius is 23..50 feet, long chord <br /> 16.46 an3 bears south 20° 31' east an arc distance of 16.82 feet <br /> to a point; thence south 410 0' cast, $,51 feet to the point of <br /> a curve; thence southerly in the arc of a curve whose radius is <br /> 19.00 feet, long chord 13..30 feet and bears. south 20° 30" east <br /> an arc distance of 13.60 feet to a po9.nt in the west line of Bunts <br /> Road; thence north in the westerly line of Eunts Road 472.23 feet <br /> to the true place of beginning, <br /> subject, however, to the following reservations: <br /> (1) That the property shall he used for street purposes only; <br /> (2) That whenever the property is no longer used for street <br /> purposes the title thereto shall revert to the Board of Education <br /> of the Lakewood School district or its successor as the case may <br /> be; <br /> <br />
