<br /> AN ~RGENCY ORDINANCE authorizing the Mayor, on beh,l* of the City of
<br />Lakewood, to enter into an agreement with Dalton - Dalton Associates, as Architects,
<br />for plan preparation and construction of a Swtmm~ng Pool.
<br />
<br /> ~HEH2AS, electors of the Oi~ of Lakewood have authorized a bond issue for
<br />the construction of a S~t~ing Pool, and
<br />
<br /> WHEREAS, this ordinance constitutes an ~ergency in that the public health
<br />and welfare requires tm~-~tate action f~ the eonstruction of a S~mming Pool, and
<br />in that it provides for the usual dail~ operation of a municipal department, now
<br />therefore, .....

<br /> BE IT ORDAINED BY THE 00UNCIL OF TH~ CITY OF IA~OOD, STATE OF OHIO:
<br />
<br /> Section 1. That the Ma~or be, and he is hereby, authorized on behalf of the
<br />City of Lakewood to' enter into an agreement with Dalton - Dalton Associates,
<br />Architects, which agreement shall provide substantially as follows:
<br />
<br /> "THIS AGREEmeNT made at Lak~wood, Ohio, this day of April, 1950,
<br />by and between the CiW of Lake~od, a municipal corporation, Lakeweod ?,
<br />Ohio. hereinafter called aOity" and Byron Dalton, Robert p. Dalton, George
<br />F. Dalton, III and Calvin B. Dalton, architects ami engineers, carrying
<br />on their prefession as parbncrs under the n~ae Dalton - Dalton Associates~
<br />The Arcade, Cleveland 14, Ohio, hereinafter called "Architects.$
<br />
<br /> F/TNESSETH~
<br />
<br /> ~P~AS, the Oity proposes to construct in Lakewood Park a fireproof
<br />public s~imming pool including an admin/stration building (locker room) and
<br />to equip said swimming pool with apparatus necessary and incidental to its
<br />use~
<br />
<br /> N0Ws THEREFORE, IT IS MUTU~I~AGREEDAS F0~nWS~
<br />
<br /> 1. The Architects agree %o perform for theabove-~a~edW°rk, pro-
<br />fessional services as follows: ~
<br />
<br />(a) All necessary conferences and the preparation of preliminary
<br />studies and plans for the swimming pool, administration building,
<br />apparatus and site improvemsnts~
<br />
<br />(b) The preparation of all necessary working drawings, specifi-
<br />cations~ small and large scale detail drawings, for architectural,
<br />structural~ plumbing, heating~ electr~Oal, and of all other mechan-
<br />ical work~ and estimates of cost ~-~ the drafting of forms of pro-
<br />posals and agreements for the purpose of obtaining building con-
<br />struction and apparatus bids;
<br />
<br />(c) Ail a~m~nistrationand supervision in connectionwith and
<br />pertaining to said swimming pool, administration building and
<br />apparatus, including customary business administration, super-
<br />vision of the work, inssuance of certificates of ps,merit and
<br />other necessary instruments, the keeping of accounts, approval
<br />ofm~terials, and general supervision of construction and pro-
<br />ject directions.
<br />
<br /> 2. The City agrees to pay the Architects for such services, a fee of
<br />six percent (6%) of the cost of the swimming pool, administration building and
<br />apparatus, which costs shall not be deemed to include the Architects~ fee or
<br />the cost of a clerk-of-the-works, which fee shall be payable as follows:
<br />
<br />(a) From time to time during the execution of the work and in
<br />proportion to the amount of services rendered by the Architects
<br />
