ORDINANCE NO. 80-58 <br /> <br />BY: Messrs. <br /> <br />Chockley, Fahrenbach, <br />Fairgrieve, Gaydos, <br />Gottermeyer, Lawther. <br /> <br /> AN ORDINANCE to amend Section 955.10 of the General Offenses Code <br />of the Codified Ordinances of the City of Lakewood, relative to liquor <br />licenses. <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br />OHIO: /- <br /> <br /> Section 1. That Section 955.10 of the General Offenses Code of <br />the Codified Ordinances of the City of Lakewood, now readings <br /> <br />"955.10 Licenses; regulations. <br /> <br />With the exception of a license to be granted to a holder of a <br />Permit F issued by the State Board of Liquor Control, the fee <br />for each license issued shall be two dollars ($2.00) per annum, <br />or any part thereof. <br />Any license issued shall be construed to run personally to the <br />licensee named therein. It shall be non-transferable and non- <br />assignable whether voluntarily or involuntarily, by action of <br />court, or opera, ion of law, and shall be terminated by the death, <br />dissolution, bankruptcy, or appointment of a receiver for the <br />licensee or by a transfer or change in ownership of fifty per- <br />cent (50%) of the financial interest therein. <br />In the event of a change of location of the place of business by <br />any licensee during the period for which any license has been <br />issued, the licensee shall notify the Director in writing of <br />such proposed change; the Director shall investigate the proposed <br />new location as for a new license and shall approve or disapprove <br />such new location on the same grounds and by the same procedure <br />as for a new license. In the event the new locationis approved <br />the change of address shall be noted on the Directorts records <br />and by him on the license. The fee for such change shall be <br />two dollars ($2.00). <br /> The fee for a license to a holder of a Permit F issued by the <br /> State Board of Liquor Control shall be one dollar ($1.00). Pro- <br /> vided, however, that any bona Fide charitable organization may <br /> by payment of a fee of one dollar ($1.00), obtain a license valid <br /> until the next December 31st, which will permit sale of beer <br /> under successive "F" Permits when and as issued by the State Board <br /> of Liquor Control during the period of such license, if before <br /> operation under each such permit, such organization gives notice <br /> in writing in advance to the Director, of its issuance and of the <br /> dates upon which sales of beer are proposed to be made under such <br /> permits. <br /> The Council hereby determines that the amount to be received by <br /> the City from the license fees hereinabove stated does not ex- <br /> ceed the estimated cost to the City arising in connection with <br /> the issuance of the licenses." <br /> <br />shall be and is hereby amended to read as follows~ <br /> 955.10 Licenses: regulations. <br /> With the exception of a license to be granted to a holder of a <br /> Permit F issued by the State BOard of Liquor Control, the fee for <br /> each license issued shall be ten dollars ($10.00) per annnm, or <br /> any part thereof. <br /> <br /> <br />
