<br /> AN EMERGENCY ORDINANCE authorizing the Mayor, as Director of
<br />Public Safety, to enter into an agreement with the Cleveland Transit
<br />System, relative to the closing of Lakewood Heights Blvd. at the New
<br />York Central Railroad.
<br />
<br /> WHEREAS, In the very near future, the Cleveland Transit System
<br />is desirous of running its rapid transit cars to the western terminus
<br />of its rapid facilities at Lorain and West l$3rd Street, Cleveland, Ohio,
<br />and
<br />
<br /> ~EREAS, Such cars would be run at frequent intervals, particu-
<br />larly at such times of the day w~nen the greatest number of motor ve-
<br />hicles on Lakewood Heights Blvd. would be crossing the New York Central
<br />Railroad tracks, and
<br />
<br /> WHEREAS, A large number of City of Lakewood vehicles use such
<br />crossing to and from the Lakewood incinerator and the water, street
<br />and park departments storage facilities, and
<br />
<br /> WHEREAS, It would be costly to the City of Lakewood to close
<br />Lakewood Heights Blvd. at the New York Central Railroad crossing at any
<br />time sooner than the earliest time required for the construction of an
<br />overpass at such crossing, and
<br />
<br /> WHEREAS, The Cleveland Transit System is prohibited from running
<br />its cars at grade across said Lakewood Heights Blvd. intersection, and
<br />
<br /> WHEREAS, The Cleveland Transit System is willing to permit City
<br />of Lakewood equipment to use a service road to and from its premises
<br />on the south side of the New York Central Railroad and also to permit
<br />the use of car barns beginning with the day that such rapid transit
<br />cars begin to run to the West l$3rd Street and Lorain terminus; such
<br />use to be rent free to the City of Lakewood, and
<br />
<br /> WHEREAS, The adoption of this ordinance is necessary for the
<br />operation of a municipal department and for the preservation of the
<br />public peace, property, health or safety, now, therefore,
<br />
<br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF
<br />OHIO:
<br />
<br /> Section 1. That the Mayor, as Director of Public Works, be and
<br />he is hereby authorized to enter into an agreement 'with the Cleveland
<br />Transit System, substantially as follows:
<br />
<br />"THIS AGREE~4ENT MADE and entered into this day of
<br />1958, by and between the Cleveland Transit 'System, hereinafter
<br />referred to as C.T.S., and the City of Lakewood, hereinafter
<br />referred to as Lakewood,
<br />
<br />WITNESSETH:
<br />
<br />C,T.S., in consideration of the promises and agreements of
<br />Lakewood hereinafter contained, agrees as follows:
<br />
<br />A) To grant to Lakewood the use of the so-called C.T.S. Detroit
<br />car barns, rent free, for the operation of Lakewood's water,
<br />street and park departments, and for the storage of such de-
<br />partments' equipment and materials, beginning as of the day
<br />that C.T.S. begins its operation of the rapid westerly exten-
<br />sion, and continuing thereafter until such time as Lakewood
<br />acquires title to such car barn premises.
