<br /> WHEREAS, The €:ity has accwnulated nwnero'Us records, docu..
<br />ments, plats, court files, papers and other instrwnents in writing,
<br />and
<br /> WHEREAS, The transporting of suc~ records to t~e new ad-
<br />ministration building would constitute a substantial expense and
<br />would result in the use and occupancy of space, and
<br /> WHEREAS, The adoption of this ordinance is necessary for the
<br />usual daily aperation of a municipal department, now, t~erefore,
<br /> BE IT ORDAINED BY THE CØWNCIL OF THE CITY OF LAKEW00D, STATE

<br /> Section 1. That Section 138.01 of t~e Administrative Code
<br />of t~e Coclified Ordinanees of the City of Lakewøod be enacted tel>
<br />read as follows:
<br /> 138.01 Commission establis~ed.
<br /> There is ~ereby created a City Records Commission to be
<br /> eomposed of the Mayor, one member of t~e Counoil, appointed
<br /> lDy 'the President, the senior judge of the MunieipalCøurt,
<br /> the Direo'tor øf Law and the Finanee Direetor.
<br /> Seetion 2. That Section 13$.02 of the Administrative Code
<br />of the Codified 0rdinances of the City of Lakewood Ge enacted to
<br />read as føllows:
<br /> 1)8.02 Destructiøn of records, required by law to be recorded,
<br /> procedure.
<br /> The commission may order the destruotion or other disþosition
<br /> of any City record, document, plat, court file, paper or in-
<br /> strument in writing, required 'to IDe recorded by law, provided
<br /> that such city record, document, plat, court file, þaper or
<br /> instrument in writing be first copied or reproduced in the
<br /> manner and according to the procedure preseribed in Section
<br /> 9.01 of the Revised Clode. Before such order may be given by
<br /> the commission, the officer or person in charge, or the ma-
<br /> jority where there are more than one, of any office, eourt,
<br /> commission, board, institution, department or agency of the
<br /> City, shall request, in writing, that such permission be
<br /> granted. When such aþplieatiøn is made by a member of the
<br /> commission, that member shall not serve in the eonsideration
<br /> of that applieation.
<br /> No order of the commission to destroy or otherwise dispose
<br /> of any rec.ords is valid \Ul1ess it is agreed to lDy each such
<br /> memGer of the commission eligible te act under this secti~,
<br /> reduced te written form and signed by each member.
<br /> Section 3. That Section 138.03 of the Administrative Cøde of
<br />the Cødified 0rdinances of the City of Lakewoed be enacte~ to read
<br />as follows:
<br /> 138.03 Destruction of records, not re~uired by law to be
<br /> recorded, procedure.
