ORDINANCE NO. 32-59 BY: Messrs. Fairgrieve, Gaydos, <br /> Cottermeyer, Lawther, <br /> ~ard, Chockley. <br /> AN EMERGENCY ORDINANCE to establish Chapter 26 of the Codified <br />Ordinances ef the City of Lakewood, and to enact Sections 526.01, 526.02, <br />526.03, 526.05 and 526.99 of the Business Regulation Code of the Codi- <br />fied Ordinances of the City of Lakewood, relating to 'resurfacing and <br />finishing of bowling alleys, gymnasium and dance floors and other sur- <br />faces in buildings frequented by the public, and to provide a penalty. <br /> <br /> I~HEREAS, This ordinance constitutes an emergency in that the <br />same provides for the immediate preservation of the public peace, <br />property, health or safety, or for the usual daily operation of a <br />municipal department, now, therefore, <br /> <br /> BE IT ORDAINED BY Thee COUNCIL OF THE CITY OF LA--WOOD, STATE <br />OF OHIO: <br /> <br /> Section 1. That Chapter 26 of the Business Regulation Code of <br />the Codified Ordinances of the City of Lakewood be enacted to read as <br />follows: <br /> <br />526.01 Definiti.ns <br /> <br />As used in this chapter, unless the context otherwise requires: <br /> <br />A) "Person" includes all persons, natural and aritficial, <br />partners, principals, agents and employees, engaged in resur- <br />facing and finishing of bowling alleys, gymnasium floors, <br />dance floors or other surfaces. <br /> <br />B) "Resurfacing" means the~..removal of the old finish from a <br />bowling alley, gymnasium floor, dance floor or other such <br />surfaces by means of a mechanical sander or any other mechan- <br />ical equipment. <br /> <br />C) "Finishing" shall mean the application of an original coat- <br />ing, or the application of a coating following resurfacing, <br />and such application is by brush, spray, roller or other such <br />means, with lacquer, varnish or material compounded with <br />flammable solvents or vehicles. <br /> <br />526.02 Persons authorized to resurface and finish surfaces. <br /> <br />No person shall resurface or finish a bowling alley, gymnasium <br />floor, dance floor and other surfaces in buildings frequented <br />by the public, ~nless he first register with the City of Lakewood <br />and obtain a permit from the chief of the division of fire to <br />perform such service. <br /> <br />The chief of the division of fire shall inspect, or cause to be <br />inspected, the conditien'and the kind of equipment that such <br />person proposes to use in connection with the performance of <br />such services, and provided that suc~. equipment conforms to the <br />requirements of the National Electric Code for Hazardous Condi- <br />tions, he is authorized to issue a permit to such person upon <br />the payment of a license fee of ten dollars. <br /> <br />The issuance of such permit shsll authorise the person to whom <br />it is issued to perform such services during the calendar year <br />in which the permit is issued; permits shall not be transfer- <br />rable, and may be revoked at any time if the standards required <br />for the iss~ance of the permit are not maintained by the person <br />to whom such permit is issued. <br /> <br /> <br />
