ORDINANCE NO. 32-59 BY: Messrs. Fairgrieve, Gaydos, Cottermeyer, Lawther, ~ard, Chockley. AN EMERGENCY ORDINANCE to establish Chapter 26 of the Codified Ordinances ef the City of Lakewood, and to enact Sections 526.01, 526.02, 526.03, 526.05 and 526.99 of the Business Regulation Code of the Codi- fied Ordinances of the City of Lakewood, relating to 'resurfacing and finishing of bowling alleys, gymnasium and dance floors and other sur- faces in buildings frequented by the public, and to provide a penalty. I~HEREAS, This ordinance constitutes an emergency in that the same provides for the immediate preservation of the public peace, property, health or safety, or for the usual daily operation of a municipal department, now, therefore, BE IT ORDAINED BY Thee COUNCIL OF THE CITY OF LA--WOOD, STATE OF OHIO: Section 1. That Chapter 26 of the Business Regulation Code of the Codified Ordinances of the City of Lakewood be enacted to read as follows: 526.01 Definiti.ns As used in this chapter, unless the context otherwise requires: A) "Person" includes all persons, natural and aritficial, partners, principals, agents and employees, engaged in resur- facing and finishing of bowling alleys, gymnasium floors, dance floors or other surfaces. B) "Resurfacing" means the~..removal of the old finish from a bowling alley, gymnasium floor, dance floor or other such surfaces by means of a mechanical sander or any other mechan- ical equipment. C) "Finishing" shall mean the application of an original coat- ing, or the application of a coating following resurfacing, and such application is by brush, spray, roller or other such means, with lacquer, varnish or material compounded with flammable solvents or vehicles. 526.02 Persons authorized to resurface and finish surfaces. No person shall resurface or finish a bowling alley, gymnasium floor, dance floor and other surfaces in buildings frequented by the public, ~nless he first register with the City of Lakewood and obtain a permit from the chief of the division of fire to perform such service. The chief of the division of fire shall inspect, or cause to be inspected, the conditien'and the kind of equipment that such person proposes to use in connection with the performance of such services, and provided that suc~. equipment conforms to the requirements of the National Electric Code for Hazardous Condi- tions, he is authorized to issue a permit to such person upon the payment of a license fee of ten dollars. The issuance of such permit shsll authorise the person to whom it is issued to perform such services during the calendar year in which the permit is issued; permits shall not be transfer- rable, and may be revoked at any time if the standards required for the iss~ance of the permit are not maintained by the person to whom such permit is issued.
