ORDINANCE NO. 60-59 BY: Messrs. <br /> <br />Gaydos, Gettermeyer, <br />Lawther, Ward, <br />Fahrenbach. <br /> <br /> AN E~ERGENCY ORDINANCE authorizing the Mayor - ex officio <br />Director of Public Safety - on behalf of the City of Lakewood, to <br />enter into an agreement with the City of Fairview Park for the <br />interchange of the service of their respective Fire Departments and <br />the use of fire apparatus, all as hereinafter more specifically <br />provided° <br /> <br /> WHEREAS, Section 717.02 of the Revised Code authorizes <br />municipalities to enter into contracts for mutual fire protection, <br />and <br /> <br /> 'EEREAS, An emergency exists, in that in the judgment of <br />this Council hazards are such as to require immediate action to <br />afford f~l protection to the City of Lakewood and its citizens; <br />and in that this ordinance provides for the immediate preservation <br />of the public peace, property, health or safety, or for the usual <br />daily operations of a municipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Mayor - ex officio Director of Public <br />Safety - is hereby authorized and directed on behalf of the City <br />Qf~Lakewood to enter into an agreement with the City of Fairview <br />Park, which said agreement shall read substantially as follows: <br /> <br />"THIS AGREEMENT made and entered into this day of <br /> , 19 , pursuant te the <br />~uthority of SeCtion 717.02 of the Revised Code, by and <br />between the 8ITY OF LAKEWOOD, a municipal corporation, <br />by its Mayor - ex officio Director of Public Safety, <br />p,zrsuant to the authority of Ordinance No. <br />passed. , and the CITY OF <br />FAIRVIEW PARK, a""municipal corporation, hereinafter re- <br />ferred to as the second party, by its Director of Public <br />Safety, pursuant to the authority of Ordinance No. <br />passed . <br /> <br />WITNESSETH: <br /> <br />That the parties hereto agree for and in consideration of <br />the mutual promises each to the other made as follows: <br /> <br />1. The~City of Lakewood agrees.to furnish, at the request <br />of the officers designated for such purpose by the second <br />party, such pieces of fire fighting apparatus as may be <br />requested, within the ability of the City of Lakewood ~ <br />so to · without unduly imperiling the safety o£ the citi- <br />zens, and without the establishment of any fire houses or <br />fixad equipment outside of the city limits. <br /> <br />2. The second party agrees te pay promptly, upon recgipt <br />of invoice therefor, the sum of Ninety Five Dollars ($95.00~) <br />for the first hour or fraction thereof for each p~ece of <br />~ppara~us so furnished, plus the sum of Sixty Five Dollars <br /> 65.00) for each subsequent hour or fraction thereof. <br /> <br />3. The second party further agrees to pay promptly, upon <br />receipt of invoice therefor, any sum charged as compensa- <br />tion for loss or damage to equipment or apparatus while <br />engaged outside the limits of the City of Lakewood under <br />this agreement. <br /> <br /> <br />
