ORDINANCE NO. 60-59 BY: Messrs. Gaydos, Gettermeyer, Lawther, Ward, Fahrenbach. AN E~ERGENCY ORDINANCE authorizing the Mayor - ex officio Director of Public Safety - on behalf of the City of Lakewood, to enter into an agreement with the City of Fairview Park for the interchange of the service of their respective Fire Departments and the use of fire apparatus, all as hereinafter more specifically provided° WHEREAS, Section 717.02 of the Revised Code authorizes municipalities to enter into contracts for mutual fire protection, and 'EEREAS, An emergency exists, in that in the judgment of this Council hazards are such as to require immediate action to afford f~l protection to the City of Lakewood and its citizens; and in that this ordinance provides for the immediate preservation of the public peace, property, health or safety, or for the usual daily operations of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor - ex officio Director of Public Safety - is hereby authorized and directed on behalf of the City Qf~Lakewood to enter into an agreement with the City of Fairview Park, which said agreement shall read substantially as follows: "THIS AGREEMENT made and entered into this day of , 19 , pursuant te the ~uthority of SeCtion 717.02 of the Revised Code, by and between the 8ITY OF LAKEWOOD, a municipal corporation, by its Mayor - ex officio Director of Public Safety, p,zrsuant to the authority of Ordinance No. passed. , and the CITY OF FAIRVIEW PARK, a""municipal corporation, hereinafter re- ferred to as the second party, by its Director of Public Safety, pursuant to the authority of Ordinance No. passed . WITNESSETH: That the parties hereto agree for and in consideration of the mutual promises each to the other made as follows: 1. The~City of Lakewood agrees.to furnish, at the request of the officers designated for such purpose by the second party, such pieces of fire fighting apparatus as may be requested, within the ability of the City of Lakewood ~ so to · without unduly imperiling the safety o£ the citi- zens, and without the establishment of any fire houses or fixad equipment outside of the city limits. 2. The second party agrees te pay promptly, upon recgipt of invoice therefor, the sum of Ninety Five Dollars ($95.00~) for the first hour or fraction thereof for each p~ece of ~ppara~us so furnished, plus the sum of Sixty Five Dollars 65.00) for each subsequent hour or fraction thereof. 3. The second party further agrees to pay promptly, upon receipt of invoice therefor, any sum charged as compensa- tion for loss or damage to equipment or apparatus while engaged outside the limits of the City of Lakewood under this agreement.
