<br /> AN EMERGENCY ORDINANCE providing for the sale of
<br />certain real property on Highland Avenue in the City of
<br />Lakewoodo
<br />
<br /> WHEREAS, The real property (hereinafter described in
<br />the body of the agreement) owned by the City of Lakewood, is
<br />no longer needed for any municipal purpose, and,
<br />
<br /> WHEREAS, The City of Lakewood is not realizing a
<br />sufficient financial return on its monies presently invested
<br />in,'said real property, and,
<br />
<br /> WHEREAS, It is in the best interest of the City of
<br />Lakewood that said real property be sold, and,
<br />
<br /> WHEREAS, The Board of Control of the City of Lakewood
<br />has directed that said real property be sold, and,
<br />
<br /> WHEREAS, This ordinance constitutes an emergency
<br />measure providing for the immediate preservation of the public
<br />health, safety and welfare and for the usual daily operation of
<br />a municipal department; now~ therefore,
<br />
<br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD,
<br />STATE OF OHIO:
<br />
<br /> Section 1o It is hereby determined that the real
<br />property described in the agreement set forth herein is no
<br />longer needed for municipal purposes°
<br />
<br /> Section 2. This Council hereby authorizes the sale of
<br />said land to Granada Amusement, Inco, and the Mayor is authorized
<br />and directed to execute, on behalf of the City of Lakewood, a
<br />contract for the sale of said property, in substantially the
<br />following form:

<br />AGREEMENT
<br />
<br />THIS AGREEMENT made and concluded at Lakewood, Ohio, this
<br />day of January, 1965, by and between the City of Lakewood,
<br />whose mailing address is 12650 Detroit Avenue, Lakewood,
<br />Ohio, hereinafter called the "Vendor" and Granada Amusement,
<br />Inco, an Ohio corporation, whose mailing address is Room 300,
<br />Film Building, 2108 Payne Avenue, Cleveland, Ohio, hereinafter
<br />called the "Vendee"~
<br />
<br />WITNESSETH:
<br />
<br />That in consideration of the mutual promises of the parties
<br />herein contained~ the VENDOR agrees to sell and convey
<br />and the VENDEE agrees to purchase and pay for, upon and
<br />under the provisions~ terms and conditions herein expressed
<br />the following described premises situated in the City of
<br />Lakewood, County of Cuyahoga, and State of Ohio:
