ORDINANCE NO. 55-65 BY: Messrs. Huffman, Usher, Ward, Wendling, Bennett, Cain, Gaydos. AN EMERGENCY ORDINANCE authorizing the Director of Public Works to enter into a contract, on behalf of the City of Lakewood, with the City of Cleveland, providing for the City of Lakewood to furnish treatment, at the newly constructed Lakewood Sewage Treatment Plant, for sewage discharged from the Cleveland sewer system and for the City of Cleveland to partici- pate with the City of Lakewood in the cost of constructing, operating and maintaining said plant. WHEREAS, This ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1o That the Director of Public Works be and he is hereby authorized and directed to enter into a contract with the City of Cleveland providing for the City of Lakewood to furnish treatment~ at the Lakewood Sewage Treatment Plant, for sewage discharged from the Cleveland sewer system and further pro- viding for the City of Cleveland to participate in the cost of constructing, operating and maintaining said plant, said contract to be in substantially the following form: AGREEMENT THIS AGREEMENT entered into at Cleveland, Ohio~ this ..... day of , , 1965, by and between the City of Lakewood (hereinafter referred to as ~'LAKEWOOD") and the City of Cleveland (hereinafter referred to as "CLEVELAND"); WITNESSETH: WHEREAS, There is presently an Agreement between LAKEWOOD and CLEVELAND providing for reciprocal treatment of a portion of the sewage of the respective cities, and, WHEREAS, The terms and conditions of said Agreement are no longer adequate by reason of the construction of the new Lakewood Sewage Treatment Plant by the City of Lakewood, and, WHEREAS, The parties to said Agreement now desire to enter into a new agreement to supersede the present agreement and have agreed to the terms and conditions thereof; Now, therefore, in consideration of the covenants and agreements hereinafter contained to be performed by the parties hereto, it is mutually agreed by and between the parties hereto as follows:
