ORDINANCE NO. 55-65 BY: Messrs. Huffman, Usher, <br /> Ward, Wendling, <br /> Bennett, Cain, <br /> Gaydos. <br /> AN EMERGENCY ORDINANCE authorizing the Director <br />of Public Works to enter into a contract, on behalf of the City <br />of Lakewood, with the City of Cleveland, providing for the City <br />of Lakewood to furnish treatment, at the newly constructed <br />Lakewood Sewage Treatment Plant, for sewage discharged from the <br />Cleveland sewer system and for the City of Cleveland to partici- <br />pate with the City of Lakewood in the cost of constructing, <br />operating and maintaining said plant. <br /> <br /> WHEREAS, This ordinance constitutes an emergency <br />measure providing for the immediate preservation of the public <br />health, safety and welfare and for the usual daily operation <br />of a municipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1o That the Director of Public Works be <br />and he is hereby authorized and directed to enter into a contract <br />with the City of Cleveland providing for the City of Lakewood to <br />furnish treatment~ at the Lakewood Sewage Treatment Plant, for <br />sewage discharged from the Cleveland sewer system and further pro- <br />viding for the City of Cleveland to participate in the cost of <br />constructing, operating and maintaining said plant, said contract <br />to be in substantially the following form: <br /> <br />AGREEMENT <br /> <br />THIS AGREEMENT entered into at Cleveland, Ohio~ <br />this ..... day of , , 1965, by and between <br />the City of Lakewood (hereinafter referred to as <br />~'LAKEWOOD") and the City of Cleveland (hereinafter <br />referred to as "CLEVELAND"); <br /> <br />WITNESSETH: <br /> <br />WHEREAS, There is presently an Agreement between <br />LAKEWOOD and CLEVELAND providing for reciprocal <br />treatment of a portion of the sewage of the respective <br />cities, and, <br /> <br />WHEREAS, The terms and conditions of said Agreement <br />are no longer adequate by reason of the construction <br />of the new Lakewood Sewage Treatment Plant by the City <br />of Lakewood, and, <br /> <br />WHEREAS, The parties to said Agreement now desire to <br />enter into a new agreement to supersede the present <br />agreement and have agreed to the terms and conditions <br />thereof; <br /> <br />Now, therefore, in consideration of the covenants and <br />agreements hereinafter contained to be performed by <br />the parties hereto, it is mutually agreed by and <br />between the parties hereto as follows: <br /> <br /> <br />
