Huffman, Usher, <br /> Ward, Wendling, <br /> Bennett, Cain, <br /> Gaydos. <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Director of <br />Public Works to enter into a contract, on behalf of the City <br />of Lakewood, with Cleveland Maintenance, Inc., providing for <br />the acceptance and disposal of refuse of the City of Lakewood. <br /> <br /> WHEREAS, This ordinance constitutes an emergency <br />measure providing for the immediate preservation of the public <br />health, safety and welfare and for the usual daily operation of <br />a municipal department; now, therefore, <br /> <br /> BE IT ORDAIMED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF 0HIO: <br /> <br /> Section 1. That the Director of Public Works be and <br />he is hereby authorized and directed to enter into a contract <br />with Cleveland Maintenance, Inc., providing for the acceptance <br />and disposal of refuse of the City of Lakewood, said contract <br />to be in substantially the following form: <br /> <br />AGREEMENT <br /> <br />THIS AGREEMENT made and concluded this day of <br /> , 1965, by and between the City of Lakewood, <br />in the State of Ohio, by its Director of Public Works, <br />party of the first part, hereinafter referred to as the <br />"CITY" and Cleveland Maintenance, Inco, party of the <br />second part, hereinafter referred to as the "COMPANY." <br /> <br />WITNESSETH: <br /> <br />The parties hereto each in consideration of the covenants <br />and agreements of the other herein contained, do hereby <br />covenant and agree as follows: <br /> <br />1. The COMPANY hereby agrees to accept and dispose <br />of all refuse and rubbish delivered to and deposited <br />in its containers by the CITY. <br /> <br />2. The COMPANY agrees to furnish a sufficient number <br />of containers to hold any and all quantities of such <br />refuse and rubbish delivered by the CITY and to locate <br />such containers at such places as from time to time may <br />be designated by the CITY. <br /> <br />3. The COMPANY will supply and maintain in operable con- <br />dition all necessary equipment for the performance of the <br />work. In order to assure the availability of equipment <br />to meet the provisions of this agreement, the COMPANY <br />must agree to have on call sufficient equipment to duplicate <br />the services contemplated. <br /> <br />4. The COMPANY shall fully protect, indemnify and save <br />harmless the CITY and its inhabitants from any and all <br /> <br /> <br />
