ORDINANCE NO. 48~ <br /> <br /> AN EMERGENCY ORDINANCE to amend Sections 329o02(d), <br />329.02(f), 329~15(p), and 329.21(b) of the Sanitary Code of <br />the Codified Ordinances of the City of Lakewood relating to <br />swi~ning pools. <br /> <br /> WHEREAS, This ordinance constitutes an emergency <br />measure providing for the public health and safety and for <br />the usual daily operation of a municipal department; now, <br />therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 329,02(d) of the Sanitary <br />Code of the Codified Ordinances of the City of Lakewood, now <br />reading as follows: <br /> <br />Section 329.02(d) Family Swimming Pool is an <br />artificial body of water, with a controlled water <br />supply, over eighteen inches in depth or 200 <br />square feet of surface area, and used or intended <br />to be used solely by the owner or lessee thereof, <br />and his family and by friends invited to use it <br />without payment of any fee. <br /> <br /> (1) Portable Family Swimminq Poo~~ is hereby <br />defined as a container resting entirely above ground <br />with its length, width or diameter measuring no more <br />than 10 feet and its depth measuring no more than <br />4 feet and designed to be easily dismantled, stored <br />and moved from one place to another. <br /> <br />be and the same is hereby amended to read as follows: <br /> <br />Section 329.02(d) Family Swimminq Pool is an <br />artificial body of water accessory to either a <br />single-family or two-family dwelling house, with <br />a controlled water supply, over 18 inches in depth <br />or 200 square feet of surface area, and used or <br />intended to be used solely by the owner or lessee <br />of said dwelling house, and his family and by <br />friends invited to use it without payment of any fee. <br /> (t) Portable Family Swimminq Pool is hereby <br />defined as a container resting entirely above ground <br />with its length, width or diameter measuring no more <br />than 10 feet and its depth measuring no more than <br />4 feet, and designed to be easily dismantled, stored <br />and moved from one place to another. <br /> <br /> <br />
