ORDINANCE NO. 48~ AN EMERGENCY ORDINANCE to amend Sections 329o02(d), 329.02(f), 329~15(p), and 329.21(b) of the Sanitary Code of the Codified Ordinances of the City of Lakewood relating to swi~ning pools. WHEREAS, This ordinance constitutes an emergency measure providing for the public health and safety and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 329,02(d) of the Sanitary Code of the Codified Ordinances of the City of Lakewood, now reading as follows: Section 329.02(d) Family Swimming Pool is an artificial body of water, with a controlled water supply, over eighteen inches in depth or 200 square feet of surface area, and used or intended to be used solely by the owner or lessee thereof, and his family and by friends invited to use it without payment of any fee. (1) Portable Family Swimminq Poo~~ is hereby defined as a container resting entirely above ground with its length, width or diameter measuring no more than 10 feet and its depth measuring no more than 4 feet and designed to be easily dismantled, stored and moved from one place to another. be and the same is hereby amended to read as follows: Section 329.02(d) Family Swimminq Pool is an artificial body of water accessory to either a single-family or two-family dwelling house, with a controlled water supply, over 18 inches in depth or 200 square feet of surface area, and used or intended to be used solely by the owner or lessee of said dwelling house, and his family and by friends invited to use it without payment of any fee. (t) Portable Family Swimminq Pool is hereby defined as a container resting entirely above ground with its length, width or diameter measuring no more than 10 feet and its depth measuring no more than 4 feet, and designed to be easily dismantled, stored and moved from one place to another.
