NO. 57-66 <br /> <br />'~BSTITUTE FOR COPY <br />iNCE SUPPLIED AT <br />1966 MEETING. <br /> <br />Gaydos, tluffman, Kelley. <br />Ward ~ Usher, Waddling <br /> <br /> AN. ORDINANCE TO provide for the submission to the <br />electorate of an amendment to Article XVI, Section 2 of the <br />Amended Charter of the City of Lakewood, Ohio, pertaining to the <br />powers and duties of the Board of Zoning Appeals. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OP THE CITY OF LAKE- <br />WOOD, OHIO, TWO-THIRDS OF ALL MEMBERS ELECTED THERETO CONCURRING: <br /> <br /> Section 1o That the question of the amendment of <br />Article XVI, Section 2 of the Amended Charter of the City of <br />Lakewood, Ohio, so that as amended the same shall be and read as <br />follows: <br /> <br />Section 2o Powers and Duties <br /> <br />"It shall be the duty of the Board of Zoning Appeals: <br /> <br /> 1o To hear and decide appeals from any regulation, <br /> order, decision, requirement, or determination made <br /> by administrative officials or agents in the applica- <br /> tion of ordinances governing zoning in the City of <br /> Lakewoodo <br /> <br />2° To hear and decide applications for special excep- <br />tions, for any of the uses which, by ordinance, require <br />approval of the Board of Zoning Appeals. In the grant- <br />ing of a special exception, the Board of Zoning Appeals <br />may prescribe such conditions and safeguards as it deems <br />necessary, desirable or appropriate° <br /> <br />3o To hear and decide all appeals made for variances <br />in the application of ordinances governing zoning in the <br />City of Lakewood. <br /> <br />No variance in the strict application of the zoning <br />ordinances of the City of Lakewood shall be granted by <br />the Board of Zoning Appeals unless it finds: <br /> <br /> a. That there exists practical difficulty or <br /> unnecessary hardship, fully described in the <br /> findings of the Board, that would deprive the <br /> owner of the reasonable use of the land or <br /> buy ding involved; <br /> <br />b. That there are special circumstances or condi- <br />tions, fully described in the findings of the <br />Board, applying to such land or buildings and not <br />applying generally to land or buildings in the <br />neighborhood, and that said circumstances or <br />conditions are such that strict application of <br />the provisions of the ordinances of the City of <br />Lakewood would deprive the applicant of the <br />reasonable use of such land or buildings; <br /> <br /> <br />
