ORDINANCE NO. 8-69 <br /> <br />BY: Messrs. Gaydos, Graber, Huffman, Kelley <br /> Usher, Wendl i,~g <br /> <br />AN EMERGENCY ORDINANCE authorizing the Mayor-Ex-Officio Director of Public <br />Safety, on behalf of the City of Lakewood, to enter into an agreement with <br />the City of Fairview Park for the interchange of the service of their <br />respective fire departments and the use of fire apparatus, all as herein- <br />after more specifically provided. <br /> <br />WHEREAS, Section 717.02 of the Revised Code authorizes municipalities to <br />enter into contracts for mutual fire protection, and, <br /> <br />WHEREAS, An emergency exists in that in the judgment of this Council hazards <br />are such as to require immediate action to afford full protectinn of the <br />City of Lakewood and its citizens, and in that this ordinance provides for <br />the immediate preservation of the public peace, property, health or safety, <br />and for the usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1~ That the Mayor-Ex-Officio Director of Public Safety, is hereby <br />authorized and directed on behalf of the City of Lakewood to enter into an <br />agreement with the City of Fairview Park, which said agreement shall read <br />substantially as follows: <br /> <br />..AGREEMENT <br /> <br />THIS AGREEMENT, made and entered into this_____day of <br /> _ ~, 196 , pursuant to the authority of <br />Sectio~ 717.02, Revise-'-d Code, by and between the City of <br />Fairview Park, a municipal corporation, by its Mayor, <br />pursuant to the authority of Section of the Codified <br />Ordinances of the City of Fairview Park, and the City of <br />Lakewood, a municipal corporation, hereinafter referred to <br />as the second party, by its Mayor-Ex-Officio Director of <br />Public Safety~ pursuant to the authority of Ordinance No. <br /> <br /> ..... adopted ....... ,196__. <br /> <br />WIT NE SSE TH: <br /> <br />That the parties hereto agree for and in.consideration o.f <br />the mutual promises each to the other made as follows: <br /> <br />The City of Fairview Park agrees to furnish, at the <br />request of the officers designated for such purpose <br />by the second party, such pieces of fire fighting <br />apparatus as may be requested, within the ability <br />of the City so to do without unduly imperiling the <br />safety of the citizens, and without the establishment <br />of any fire houses or fixed equipment outside the city <br />limits. · <br /> <br />The second party agrees to pay promptly, upon receipt <br />of invoice therefor, the sum of ninety-five dollars <br />($95.00) for the first hour or fraction thereof for <br />each piece of apparatus so furnished, plus the sum <br />of sixty-five dollars ($65.00) for each subsequent <br />hour or fraction thereof. <br /> <br /> <br />
