OILDXNANCE NOr 68-69 BY: Messrs. Gaydos, Graber, lluffman, ', Kelley, Usher, Ward AN ORDINANCE to supplement thc Zoning Code of the Codified Ordinances of the City of Lakewood by enacting new Chapter 12 to provide for Cluster IIouse Developments. BE IT ORDAINED BY TtLE COUNCIL OF THE CITY OF LAKA~OOD, STATE OF OHIO: Section 1. That the Zoning Code of the Codified Ordinances of the City of Lakewood, be and the same are hereby supplemented by enacting a new Chapter 12, to read as follows: CHAPTER 12 Cluster House Developments Secti6n 1112.01 Cluster House Development; Definition. A cluster house development is a group of single family detached residences arranged around a central courtyard, upon a parcel of land under common ownership,, planned and developed as a whole in a single development operation, with a program for the future maintenance and repair of all the land, improvements, facilities and services as will be for the common use by all of'the building owners in the development. Section 1112.02 Cluster House Development; Requirements. ~ a'Class A Area District, a Cluster House Development is ~_rmitted provided that the conditions hereinafter speci- f_ied are ~ulfilled: .i Only single family detached dwellings shall be erected. One dwelling for each 14,000 square feet of land area sh~ll be permitted, provided that the density shall ~ot be increased beyond that which would be permitted ~n the .lot under the subdivision regulations contained ~m the Codified Ordinances. Proper.provisions shall be made for the ownership of all the land in the development to be in the name of the developer until such time as a sufficient number of dwellings are sold to permit the formation of a ~mroperty owners association at which time the title to all of said land shall be transferred to such association. Membership in the property owners ~sociation shall be limited solely to the owners of the dwellings in the development. 4~ Covenants shall be included in the deed for each ~P~elling sufficient to ensure that the use of all the land will be consistent with the provisions of this ordinance governing Cluster House Developments as well as to guarantee that all the land in the development, ~:ogether with all improvements, facilities and services as will be for the common use by all of thc building ~wners in the development, will be kept in good main- t~nanco and repair. Sewer and water lines beyond the ~rb shall be installed by the developer and maintained ~y th~ association, with separate water meters installed .~ ~ach homo.
