WIIEILEAS, Thi~ ordinance constitutes an emergency measure providinl: for the immediate preservation of thc public llcalth, safety and welfare and for the usual daily operation of municipal departments; now therefore, BE IT ORDAINED BY TIlE COUNCIL OF TIlE CITY OF LAKEWOOD, STATE OF OttIO: Section 1. That the Administrative Code of the Codified Ordinances of the City of Lakewood be and the same is hereby supplemented by enacting a new Chapter 157 to read as follows: CMAPTER 157 COLLECTIVE BARGAINING Section 157.01 Statement of Folicy It is hereby declared to be the poli~y of the Council of the City of Lakewood through its Finance Committee and/or its designated representative(s) to bargain collectively with City employees, their employee organizations or other authorized representatives on matters pertaining to wages, hours and conditions of employ- merit before any final determination is made by the City Council: Provided that wherever said employees are represented by an employee organization, the employee organization can establish to the satis- faction.of the Finance Committee that it represents a majority of employees in a bargaining unit whose appropriateness has been determined by said Committee. Nothing contained herein shall be deemed to supersede the Charter, O~dinances and Rules of Departments of the City which establish and/or regulate a merit or civil service system or which provide for'other methods of administering employer-employee relations. Th~s Ordinance is intended, instead, to strengthen merit, civi~ me=vice and other methods of administering employer-employee ~elations through the establishment of uniform and orderly methods of communication between City employees and the City by which they are employed. Section 157.02 Definitions (a) "City employee" means any employee of the City except elected officials, administrative officials and persons in supervisory and confidential positions or employees of Lakewood ttospital. (b) "Employee organization" means any lawful association, fraternal order, labor organization, federation, council or brotherhood having as its primary purpose the improvement: of working conditions of public employees; but shall not include any organization (1) which discriminates with regard to the terms and conditions of membership because of race, color, creed or nation'al ori~;in; and (2) which, in the opinion of thc Finance-Committee, is so subject to cor~spt ~nfluenccs or influences opposed to l~asic democratic principles that recoF, nition would be inconsistent with the objective of this O~dinance. (c) "City" means the City of Lakewood or any agency, in:;trumentality 01: departme,~t thereof and/or elected or administracivt: olficial:; who exerci~;e I:overnmc'ntal powers; under the Ortlinance~ ol thc City.
