ORDINANCE NOo 56-72 BY: Messrs. Brockman, Graber, Kelley, Magnotto~ McBride, Usher, Wendling AN EMERGENCY ORDINANCE to amend paragraphs (a) and (b) of Section 769.08 of the Business Regulation Code of the Codified Ordinances of the City of Lakewood relating to taxicab fare rates in the City of Lakewood. WHEREAS, this Council has been advised that the City of Cleveland and other areas of the county have adopted legislation to permit an increase in taxicab fare rates in said.areas, and WHEREAS, this Council deems it to be in the best interests of the City and its residents that taxicab fare rates be reasonably comparable through- out the entire area served by t~xicab companies, and WHEREAS, this ordinance provides for the usual daily operation'of a mu. nicipal department and for the immediate preservation of the public safety and welfare, now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That paragraphs (a) and (b) of Section 769.08 of the Business Regulation Code of the Codified Ordinances of the City of Lakewood, now reading as follows: . 769.08 PATES OF FARE (a) Metered Rates. All charges for' metered service of a taxicab shall be in units of fractions of a mile which shall not be greater than one-half nor less than one-fifth of a mile, and the fare charged shall be either five cents (5~) or ten .cents (106) per unit, except, however, that for the first unit or flag drop an additional charge may be made. Alternatively, the charges may be on an hourly or flat rate basis as provided in subsection (b) hereof. On the basis of unit charges, no charge for service by a taxicab shall be made at a rate of fare less than fifteen cents (15~) for the first mile and ten cents (106) for each succeeding mile. A charge not exceeding ten cents (106) for each additional passenger may be made, provided that the total of the basic taximeter fare charged plus the charge for extra passengers does not exceed the maximum rate of fare permitted above. For waiting time, as hereinafter defined, charges may be made at the rate of not less than two dollars and ten cents ($2.10) nor more than four dollars and twenty cents ($4.20) per hour. Waiting time shall be deemed to include the time when the taxicab is not in motion, beginning at the place of arrival to which it has been called, or the time consumed while standing at the direction of the passenger. However, no charge shall be made for time lost because of the inefficiency of the taxicab or its operator, or for time consumed by premature response to the ~assenger's order.
