Sinagra, Usher, Bro~kman, Chinnock, Graber, Magnotto, McBride AN EMERGENCY ORDINANCE supplementing Part Three - Traffic Code of the Codified Ordinances of the City of Lakewood by enacting new paragraph (d) of Section 331.01, new paragraph (c) of Section 331.33, new paragraph to Section 331.38, new paragraph (c) to Section 331.49, new paragraph (i) to Section 339.04, new paragraph to Sectisn 351.26, new paragraph to Section 351.27, and new paragraph (f) to Section 355.06, all relating to classification and penalties for Traffic Code offenses. WHEREAS, included in amended House Bill 511, effective January 1, 1974, was the classification of misdemeanors, and ~'- ~ WHEREAS, the Codified Ordinances of the City of Lakewood should be supplemented to conform to State law at the earliest possible time, and WHEREAS, this Ordinance constitutes an emergency measure providing for th~'immediate preservation of the public health, safety and welfare amd for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO Section 1. That Section 331.01 of the Traffic Code be and the same is hereby supplemented by enacting new paragraph (d) to read as follows: SECTION 331o01 DRIVING OR PHYSICAL CONTROL WHILE UNDER iNFLUENCE: TESTS: PRESUMPTIONS. (d) Whoever violates subsection (a) hereof is guilty of a misdemeanor of the first degree, in addition to the license suspension or revoca- provided in Section 4507.16 of the Ohio Revised Code Section 2. That Section 331o33 of the Traffic Code be and the same is hereby supplemented by enacting new paragraph~(c) to read as follows: SECTION 331.33 SAFETY PRECAUTIONS AT RAILROAD CROSSINGS (c) Whoever violates this Section for a first offense is guilty of a minor misdemeanor; for a second and subsequent offenses such person ts guilty of a misdemeanor of the fourth degree° Section 3. That Section 331.38 of the Traffic Code be and the same is hereby supplemented bY enacting a new paragraph t° read as follows: SECTION 331.38 UNAUTHORIZED ENTRY OF MOTOR VEHICLES Whoever violates this Section is guilty of a misdemeanor of the first degree. Section 4.
