McBride, Sinagra, Brock.lan, Chinnock, Nagnotto AN EMERGENCY ORDINANCE to supplement Chapter 725 of the Business Regulation COde of tile Codified Ordinances of the City of Lakewood by enacting new Sections 725.04, 725.05, 725.06, 725.07 and new paragraph (d) of Section 725.99 to require a permit to operate traveling, portable amusement rides or devices within the City. ~ WHEREAS, Section 1711.11 of tile Ohio Revised Code provides for the licensing of portable amusement rides and delegates to the Ohio Department of Agriculture the responsibility of the regulation and enforcement of licensing, inspection and operation of such rides, and WHEREAS, in order to assure tile safety of the residents of this community using such rides, some local control over such rides should be maintained, and WtIEREAS, 'this Ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare and for the further reason that local control over tile operation of portable amusement rides should be established at the earliest possible time; now., therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Chapter 725 of the Business Regulation Code of the Codified Ordinances of the City of I~akewood shall be and tile same is hereby supplemented by enacting new Sections 725.04, 725.05, 725.06, 725.07 and new paragraph (d) of Section 725.99 to read as follows: ' C}[A PTER 725 Exhibitions, Stunts and Amusements 725.04 PORTABLE AMUSEMENT RIDES; PERMI'T REQUIRED No person, firm' or corporation, either as owner, lessee, manager, officer or agent, or in any capacity, shall operate or cause or permit to be operated witllin tile City any traveling, portable amuse,nent ride(s) or device(s) that is not affixed to a permanent foundation withe'ut first obtaining from tile Permit Clerk a permit authorizing such operation. 725.05 PORTABLE AMUSEMENT RIDES; PERMIT APPLICATION Applications for the permit required pursuant to Section 725.04 shall be made to the Building Department, shall be for a specified period of time and shall be on forms prescribed and furnished by the City. Such application shall specify the name and address of the person, firm or corporation making such application, the place where such portable amusement ride(s) or device(s) is to be operated, the description of each such ride(s) or device(s), tile dates on which it is intended to operate such ride(s) or device(s) and such other and further information as may be required by the City. Each applicant shall'be charged with tile duty of reporting any newly installed, portable amusement ride(s) or device(s) or any substitu- tions made during the permit period. 725.06 PORTABLE AMUSEbLENT RIDES; PERMI'r ISSUANCE The Permit Clerk, upon tile payment of a permit fee of Ten Dollars ($10.00), shall issue a permit pursuant to tile provisions of this Chapter and such application, upon determination by tile Building Commissioner that tile. applicant is in compliance with Ohio Revised Code 1711.11 (II) and all Ohio Department of ^griculture rules and regulations relating thereto; that eacl~ ride(s) or device(s) proposed to be operated by tile Applicant bears a current seal or emblem issued by the Ohio Department of Agricult'ure; that a temporary el(;ctrical permit has been issued to tile applicant; and that all ride(s) or device(s) are in safe operating condition.
