ORDINANCE NO. 28-75 BY: Messrs. Chinnock, Graber, Magnotto, McBride, Sinagra, Usher, Brockman AN EMERGENCY ORDINANCE to amend Section 1305.44 of the Housing Code of the Codified Ordinances of the City of Lakewood to adjust the fees for Housing License~for condominium property. WHEREAS, on December 2, 1974 this Council enacted a new Housing Code of the'Codified Ordinances of the City of Lakewood~ and WHEREAS, the fee for a housing license provided for therein is the same for apartment house structures and condominiums, and WHEREAS, this Council believes there are significant differences between the condominium ownership and the occupancy of apartment buildings, and the necessary inspections relating thereto and, therefore, the fees for a housing license for condominium property should be adjusted accordingly~ and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE. CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That SeCtion 1305.44 of the Housing Code of the Codified Ordinances of the City of Lakewood now reading as follows: 1305.44 LICENSE APPLICATION.FORM AND FEE Every application for a housing license shall be on a form approved by the official charged with the enforcement of this Code. It shall state the name and address of the applicant, the nature and extent of his interest in the building for which the license is required, the name and address of the owner of the building, the location of the building, the number of rooms therein, the number of dwelling units therein, the number of rooming units therein and such other informa- tion as may be required by the official charged with the enforcement of this Code. The fee for such license shall be five dollars ($5.00) for each dwelling unit and five dollars ($5.00) for each rooming unit in each building for which a license is required, but in no case shall such fee be less than twenty-five dollars ($25.00) nor more than One Thousand Dollars ($1,0Q0.00). Such fees shall be paid to the City when the application for the license is made. shall be and the same is hereby amended to read as follows: 1305.44 LICENSE APPLICATION FORM AND FEE Every application for a housing license shall be on a form approved by the official charged with the enforcement of this Code. Except for condominium property, the fee for such license shall be five dollars ($5.00) for each dwelling unit and five dollars ($5.00) for each rooming unit in each building for which a license is required. For condominium property the fee for such license shall be five dollars ($5.00) for each rented condominium unit and one dollar ($1o00) for each owner-occupied condominium unit. In no case shall the fee provided for herein be less .than twenty-five dollars ($25.00) nor more than one thousand dollars ($1,000.00).
