ORDINANCE NO. 5-76 <br /> <br />BY: Messrs. Brockman, Chinnock, Magnotto, <br /> McBride, Sinagra, Usher, Salmon <br /> <br /> AN EMERGENCY ORDINANCE giving consent of the City of Lakewood, <br />Cuyahoga County, Ohio to the replacement of the Rocky River Bridge and approaches <br />on Detroit Avenue over the Rocky River, under the supervision of the County of <br />Cuyahoga and the Department of Transportation, State of Ohio and proposing to <br />cooperate with the County of Cuyahoga and the Department of Transportation, State <br />of Ohio, in certain matters incident thereto. <br /> <br /> WHEREAS, the County of Cuyahoga and the Department of Transporta- <br />tion, State of Ohio is considering the improvement of the public highway which is <br />described as follows: Replacement of Bridge No. 66 and approaches on Detroit <br />Road over Rocky River, and <br /> <br /> WHEREAS, The Council of the City of Lakewood desires to cooperate <br />with the County of Cuyahoga and the Department of Transportation of the State of <br />Ohio in the construction of the replacement of the Rocky River Bridge and the <br />approaches on Detroit Road over the Rocky River, and <br /> <br /> WHEREAS, this Ordinance Constitutes an Emergency Measure providing <br />for the preservation of the public peace, health and safety, such emergency <br />existing by reason of the present condition of said Bridge and by reason of the <br />inadequacy of such Bridge and approaches to handle existing and anticipated <br />vehicular traffic between the points hereinafter designated; and fo~ the further <br />reason that it is necessary to expedite the development of the plans for the re- <br />placement of said Bridge and approaches; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That it is hereby declared to be in the public interest <br />that the consent of the City of Lakewood be and such consent is hereby given to <br />the County of Cuyahoga and the Department of Transportation, State of Ohio, to <br />construct the above described improvement, in accordance with plans, specifica- <br />tions and estimates as approved by the County and the Department of Transporta- <br />tion, State of Ohio. <br /> <br /> Section 2. That the City of Lakewood hereby proposes to cooperate <br />with the County of Cuyahoga and the Department of Transportation, State of Ohio, <br />in the cost of the above described improvement as follows: <br /> <br /> (a) Pay the cost of any relocations, revisiQns and/or <br /> adjustments of sanitary sewers and waterlines and <br /> their respective appurtenances made necessary by <br /> the construction of the above described improve- <br /> ment as follows: <br /> <br /> (1) Fifteen percent (15%)for portion within structure <br /> <br /> (2) Nine percent (9%)for portionoff structure <br /> <br /> (b) In no event, shall the City of Lakewood be obligated <br /> to pay more than $10,000.00 as its share of the <br /> costs in the above-described improvements. <br /> <br /> Section 3. That the Mayor be and he is hereby authorized and <br />directed to enter into maintenance and parking agreements and special contractual <br />obligations. <br /> <br /> Section 4. That upon completion of said improvement the City of <br />Lakewood will thereafter keep said highway open to traffic at all times, and <br /> <br /> (a) Maintain the improvement in accordance with the provisions <br /> of the statutes relating thereto and make ample financial <br /> provisions for such maintenance; and <br /> <br /> (b) Maintain the right-of-way and keep it free of obstructions <br /> in a manner satisfactory to the County of Cuyahoga and the <br /> Department of Transportation, State of Ohio, and hold said <br /> right-of-way inviolate for public highway purposes and <br /> permit no signs, posters, billboards, roadside stands or <br /> other private installations within the right-of-way limits; <br /> and <br /> <br /> <br />
