Salmon, Sinagra, Usher, Brockman <br />Chinnock, Magnotto, McBride <br /> <br />AN ORDINANCE to supplement the Zoning Code of the Codified Ordinances of the <br />City of Lakewood by enacting a new Chapter 1116 and amending Section 1103.01 <br />of said Code to establish a new type of district, a Business-Residential (BR) <br />District within the City. <br /> <br />WHEREAS, The City of Lakewood Planning Commission has been working for the past <br />year and a half on developing a classification that would permit and encourage <br />business devel, opme. nt and structure immrovement on Madison Avenue and be in keeping <br />with modern trends in land redevelopment in many cities in the nation; now, <br />therefore, <br /> <br />BE IT ORDAINED BY Tile COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That the Zoning Code of the Codified Ordinances of the City of Lakewood <br />be and are hereby supplemented b~ enacting the new Chapter to read as follows: <br /> <br /> CHAPTER 1116 <br />Business-Residential BR <br /> <br />[]16.01 GENERAL Pt'.OVISIONS. <br />The following re..lu.lations shall apply tc, all Business-Residential Districts (BR). <br /> <br />l]16.02 I'EI1H[TTEI) PR]NC[P~, USES. <br />In a BR District no building or premises shall be used or established which is <br />designed, arranged or intended for other than the following: <br /> <br />(a) Apar-tment houses, single and two family dwellings. <br /> <br />(b) Office bui. ldings, banks, savings and loan offices, telephone exchange, <br /> barber shops, beauty shops, social and fraternal assembly halls. <br /> <br />(c) Ret'ail store. <br /> <br />(d) <br /> <br />(e) <br /> <br />(~.) <br /> <br />Class IV dry cleaning establishments as defined in Ohio Revised Code, <br />Section 3739.10 and subject to the requirements of Ohio Revised Code, <br />Section 3739.14 and the Rules and Regulations for Class IV Dry Cleaning <br />Systems as promulgated by the State Fire Marshall, November, 1-965. <br /> <br />Restaurants, taverns, hotels and motels <br /> <br />Francl{ised agencies for sale, service and repair of motor vehicles, <br />including the sale of automobiles in the open. <br /> <br />(g) Skating rinks, dahce halls, theatres and bowling alleys. <br /> <br />(h) Florists, commercial school. <br /> <br />(i) Coin operated laundry and coin operated dry cleaning. <br /> <br />(j) Dry 'cleaning and laundry pick-.up office. <br /> <br />(k) <br /> <br />Any other building, retail use or service, which the Board of Zoning <br />Appeals finds to be similar to the uses or services listed in this <br />section in type of goods or services sold, in business hours, in the <br />number of persons or cars attracted to the premises, in the number of <br />persons employed and in the effects upon adjacent areas. <br /> <br />(1) <br /> <br />In a BR Dist. rict, any of the permitted uses above may be combined in <br />thc same building on a lot provided: <br /> <br />(1) No dwelling units are on the g~ound floor. <br /> <br />(2) <br /> <br />A building having combined residence with another permi'tted use, <br />the usc other than residence shall be limited to the ground floor <br />unless each consecutive floor above is devoted entirely to a per- <br />mitted use other than residential. <br /> <br /> <br />
