ORDINANCE NO~ 45-77 BY: Messrs. Chinnock, Magnotto, McBride, Salmon, Sinagra, Usher, Brockman -. AN EMERGENCY ORDINANCE to amend Sections 151~01 and 151.02 of Chap~er 151 of the Administrative Code of the Codified Ordinances of the City,jof Lakewood relating to sundry claims. WHEREAS, Section 151.01 of Chapter 151 of the Administrative Code of the Codified Ordinances of the City of Lakewood which presently provides in part that sundry claims be referrnd not only to the Mayor. and to the Director of Law, but also to the chairman of the "Council committee on claims", and WHEREAS, the ~ity of Lakewood does not.presently have ~a committee on claims, and ~' WHEREAS', this Council is of the opinion that the'maximum limit for such claims, which limit was established in 1953, is presently inadequate and ought to be raised. ~ t! BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 151.01 of Chapter 151 of the Administrative' Code of the Codified Ordinances of the City of Lakewood which presently reads as follows: 151.01 SETTLEMENT OF CLAIMS OF $100 OR LESS Ail small, unliquidated claims, actions, causes of action ~nd demands in favor of or against the City shall be referred to the Mayor, the chairman of the Council committee on claims and the Director of Law. They are hereby authorized to consider such claims and to settle, adjust and compromise all lawful actions, causes of action, clafms and demands in favor of or against the City, providing such settlement, adjustment and compromise may be affected for the sum of one hundred. dollars ($100.00) or less for such such claim. be and, the same is hereby amended to read as follows: ! 151.01 SETTLEMENT OF CLAIMS OF .$300 OR LESS Ail small, unliquidated claims, actions, causes of action and aemand~s in favor of or against the City ~shall be referred to the Mayor, the chairma~ of the. Finance Committee of Council and the Director of Law. They are hereby authorized to consider such claims and to settle, adjust and compromise all lawful.'actions, causes of 'action, claims and demands in favor of or against the City, providing such settlement, adjustment and compromise ~ay be affected for the sum of three hundred dollars ($300~00) or less for such claim. Secti~on 2. That Section 1.51.02 ~f Chapter 15l of the~Admln{strmt{ve Code of the Codified Ordinances of the City of Lakewood which presently reads as follows: 151.02 PAYMBNT AND ACCEPTANCE OE CLAIMS OF $100 OR LESS The Director of Finance, upon approval of the compromise and settlement Of any such action, cause of action, claim or demand against the City for the sum of one hundred d~llars ($100.00) or ].ess by the Mayor, the eh'airman of the Council committee on claims and tae Director of Law, is hereby authorized and directed to pay the a~ount so approved, upon obtaining satisfactory release, and charge the-amount to the proper fund. The Director of Finance is hereby authorized and'directed to accept payment' of any such claim in favor of the City amounting to the sum of one hundred dollars ($100.00) or less upon the approval of such settlement, adjustment and compromise thereof by the Mayor, chairman of the Council committee on claims and the Direc[or of Law, to execute proper receipt or release therefor and to credit any such. amount to the proper fund.
