PLEASE StJI~S'rlT~TJ:; FO{ O]{IGINA <br />ORDINANCE NO. 92-78 ~tlCH WAS <br />PI~ ON FI~T READI~ <br />~BI~ 16, 1972 ~ SE~M) <br />RF~I~ N~~ 6, 1978 <br /> <br />ORDINANCE NO. 92-78 <br /> <br />Brown, Chinnock, Magnotto, McBrid <br />Salmon, Wendling, Brockman <br /> <br /> AN t~ff~3ENCY ORDINANCE to amend Section 505.02 of the General <br />Offenses Code of the Codified Ordinances of the City of Lakewood relating <br />to the impounding and disposition of animals. <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the usual daily operation of a mLmicipal department; now, therefore, <br /> <br />OHIO: <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> <br /> Section 1. That Section 505.02 of the General Offenses Code of <br />the Codified Ordinances of the City of Lakewood now reading as follows: <br /> <br />505.02 IMPOUNDING AND DISPOSITION: REOORDS <br /> <br /> (a) A police officer or animal warden shall impound every <br />animal or dog found in violation of Section 505.01. If the impounded <br />dog is not wearing a valid registration tag, the dog shall forthwith <br />be turned over to an officer 9harged by law with the custody and <br />disposal of such dogs. If the dog is weariflg a valid registration <br />tag or the identity of the owner or harborer is otherwise established, <br />notice shall be given within two days to such owner or harborer that <br />the dog has been impounded. Notice may be by telephone or by <br />ordinary mail to the last known address of such owner or harborer. <br />The dog shall not be released except upon the payment of the following <br />charges: for impounding any dog, three dollars ($3.00); for giving <br />notice, three dollars ($3~00); for keeping any dog, four dollars <br />($4.00) per day. Any dog not redeemed within three drys after <br />notice is given to the owner or harborer as provided herein, or <br />within three days of the time it is seized or impounded, if the <br />owner or harborer cannot be found, may be sold or otherwise disposed <br />of as provided in Ohio Revised Code Section 955.16. <br /> <br /> (b) A record of all dogs impounded, the'disposition of the <br />same, the owner's name and address, if known, and a statement of <br />any costs or receipts involving such dog shall be kept. <br /> <br /> (C) The animal warden shall impound every cat found in <br />violation of Section 505.01. If the cat is wearing an identification <br />tag or the identity of the owner or harborer is otherwise established, <br />notice shall be given within two days to such owner or harborer that <br />the cat has been impounded. Notice may be by telephone or by ordinary <br />mail to the last known address of such owner or harborer. The cat shall <br />not be released except upon the payment of the following charges: for <br />impounding any cat, three dollars ($3.00); for keeping any cat, three <br />dollars ($3.00) per day.
